Fachin's allies advocate that he bring a proposal to the plenary to resolve the crisis between Mendonça and Moraes

Allies of the president of the Federal Supreme Court (STF), Luiz Edson Fachin, argue that he bring to the plenary a proposal that provides answers to the two protagonists of the "Master crisis" in the Court. And they don't even rule out discussing punishment for the two colleagues. Both for André Mendonça and Alexandre de Moraes.

Mendonça must be warned for what was considered an invasion of the prerogatives of the Federal Police and the Attorney General's Office when the magistrate advanced data involving his colleague.

Moraes because he needs to explain his connection with Daniel Vorcaro and clarify whether he took any measures to benefit the former banker.

According to Edson Fachin's interlocutors, the crisis has reached a point never seen before within the court, with an open war between two ministers, and that this demands some type of decision to show that the Supreme Court is not defending its ministers and acting in a corporatist manner.

"It will not be possible to sweep all this under the carpet, as happened in the Toffoli case. It is necessary to show society that the court does not spare its peers", said an ally of Edson Fachin privately.

The president of the STF already adopted an important measure this Friday (4), removing Alexandre de Moraes' request against André Mendonça from the scope of the fake news inquiry and taking the claim to his office.

Fachin joined Moraes' request to André Mendonça's and ordered that everyone involved in the "Master crisis" send, within five days, explanations so that the president of the STF can make a decision on what will be discussed in the plenary.

According to Fachin's team, the case will be submitted to the physical plenary. The expectation is that the temperature, which this Thursday (3) reached an explosive point, will drop in the coming days with the weekend and the Sete de Setembro holiday.

Afterwards, the president of the STF will await responses from all sides to define what he should propose to the court's plenary.

Behind the scenes, ministers from both wings believe that Fachin lacked leadership in handling the crisis, which increased the conflict between Moraes and Mendonça.

Members of the Court heard by the blog under condition of reserve point out that the president of the STF should have been more emphatic in the conversations in an attempt to reach some understanding or even establish a protocol between colleagues to avoid public attacks, which is seen as a way of even delegitimizing the Supreme Court and reinforcing external attacks.

Fachin's interlocutors, however, claim that the president has acted firmly and intensely to preserve the Court in the face of the escalating crisis and also to avoid a public war between the two colleagues.

These assistants mention that the president has held intense meetings not only with Moraes and Mendonça, but also with their interlocutors and spoken individually with all ministers to build a joint solution.
