The Investment Promotion Department of the Ministry of Economic Affairs organized the "Charging Stations for Taiwanese Businessmen" exchange event last month, and entrusted Shang Cheng Law Firm to invite Taiwanese businessmen who were victims of going to China to share their practical experience in cross-strait investment. The Taiwanese businessmen attending the meeting decided to establish the "Association of Taiwanese Businessmen Victimized in Mainland China" and elected Wu Sizhong, former chairman of the Electricity and Electronics Association and chairman of Xiling Electronics, as the first convener.
Wu Sizhong said that Taiwanese businessmen have been treated unfairly by the judiciary in China, but have nowhere to redress their grievances. Before 2016, in accordance with the Cross-Strait Investment Guarantee and Promotion Agreement, the Taiwan Affairs Office of the State Council sent personnel to Taiwan and the Ministry of Economic Affairs every three months to review the progress of legal cases against Taiwanese businessmen on a case-by-case basis. However, in the past ten years, Taiwanese businessmen have lacked protection, and the number of victims of Taiwanese businessmen may have exceeded 1,000. However, there is currently no smooth response channel.
The "Association of Victimized Taiwan Businessmen in Mainland China" also made a four-point appeal to Chinese leader Xi Jinping:
1. Ask Xi Jinping to personally care about the plight of Taiwanese businessmen who are being persecuted, and ask China's judiciary to treat the Taiwanese people with fairness and justice. Taiwanese businessmen believe that the Taiwan Affairs Office of the State Council is indifferent to Taiwanese businessmen who have been harmed after exchanges.
2. Restore the mechanism for the Taiwan Affairs Office of the State Council and the Ministry of Economic Affairs to regularly review the progress of legal cases involving injured Taiwanese businessmen. The Association of Victimized Taiwanese Businessmen stated that since 2016, the cross-strait governments have not communicated, which has had a huge impact on victimized Taiwanese businessmen. Foreign businessmen are protected by the embassy when they are harmed in China, but Taiwanese businessmen are like abandoned children, with no one caring about them, which indirectly encourages the corrupt forces at the central and local levels to do whatever they want to Taiwanese businessmen. Taiwanese businessmen hope that the investment protection agreement signed by the two sides of the Taiwan Strait should be implemented. Taiwanese businessmen call on Xi Jinping to agree to restore the cross-strait mechanism for regular review of the progress of cases of Taiwanese businessmen victimized, and instruct the Taiwan Affairs Office of the State Council to report the results to the central government.
3. The Taiwan Affairs Office of the State Council has responsibilities but not powers. It is recommended that China establish a "Taiwan-related Case Handling Group" in the Supreme Court to handle cases involving Taiwanese businessmen. The Association of Victimized Taiwanese Businessmen stated that the Taiwan Affairs Office of the State Council is the coordinating unit for cases involving Taiwanese businessmen, rather than the unit of authority that handles them. When faced with powerful central or local corrupt officials using administrative or judicial means to oppress Taiwanese businessmen, the Taiwan Affairs Office is often powerless. Over time, it chooses to avoid the most important cases, or simply ignores them. This causes the corrupt to believe that Taiwanese businessmen can be bullied, and the situation of Taiwanese businessmen becomes increasingly difficult. Therefore, it is necessary for the Central Committee of China to set up a "Taiwan-related Case Handling Group" in the Supreme Court to cooperate with the Taiwan Affairs Office of the State Council to track and handle cases involving Taiwanese businessmen.
4. China is requested to continue to implement Xi Jinping's declaration of "anti-corruption and rule the country according to law," and is particularly concerned about Taiwan-related corruption cases. Cases of persecution of Taiwanese businessmen are mostly related to the corrupt second generation of the new central or local elites. Taiwanese businessmen hope that Xi Jinping will continue to implement "anti-corruption and rule the country according to law." Special attention should be paid to Taiwan-related corruption cases, so that the people of Taiwan can feel the fairness and justice of China's judiciary, which will be helpful to cross-strait exchanges and integration.
