但是有原則就有例外,正業地政士聯合事務所所長鄭文在提到,有對情侶在2025一同購買預售屋,因為出資各半,所以在預售合約書裡買方為共同買受人聯名簽約,並約定成屋以後各辦理登記2分之1所有權。
日前建設公司接獲買方要求,希望未來登記時改成只登記一人,是否可以?因為該預售屋買賣簽約日期在平均地權條例修正以後,所以買受人及建設公司必須符合相關規定,避免違反法律受罰。
鄭文在說,經查當初預售買賣契約書上買方屬於共同買受人,而且在預售買賣契約書上各自簽名,入帳的金流也是個別獨立,應該有機會完成讓與或是轉售。
依照預售屋例外得讓與或轉售的情形可分為「不需申請即可轉售」與「審查後可轉售」兩大類,後者經過主管機關審查後可以轉售,但是每2年只能換約1戶。而此對情侶個案屬於「審查後可轉售」的情形,所以必須送預售屋轄區地政事務所審查,才知道是否准許。
鄭文在表示,此次個案之所以可以讓與或轉售,完全是因為當初的預售合約書上買受人聯名簽約且金流明確,如果當初只有一人名字簽約,另外一人「隱名合夥」或是「借名登記」,屆時要換名登記所有權人,可能就會和法令牴觸而無法辦理,必須等原買方取得所有權登記後,再辦理移轉2分之1給共同承買人。
鄭文在提醒,想要聯名購買預售屋的共同買方,無論未來成屋時要登記給誰,記得以聯名的方式辦理簽約,避免未來要換約時,無法辦理,而多負擔一筆高額的契稅、印花稅及代書費,甚至衍生法律爭議。
