Judge refuses to annul the 'Plus Ultra case' and validates the legality of the investigation against Zapatero

The judge investigating the 'Plus Ultra case' refuses to annul the case as requested by the defense of former Prime Minister José Luis Rodríguez Zapatero. José Luis Calama considers that the judicial investigation has complied with the law and that at no time have the rights of the historic socialist leader been violated, investigated as allegedly responsible for a criminal plot dedicated to the collection of commissions in exchange for operations such as the public rescue of the controversial Spanish airline with Venezuelan capital. In this way, he destroys one of Zapatero's main lines of defense, who has denounced from the first moment that he is being the victim of an investigation full of illegalities.

Following the criteria of the Prosecutor's Office, the judge concludes, first of all, that Zapatero's right to the judge predetermined by law has not been violated when the Investigative Court 15 of Madrid opened the separate piece that led to the summary that maintains a former Spanish president as being investigated for the first time in democracy. The instructor considers that the separate piece does not arise from new facts unrelated to the parent cause and, therefore, supports its initiation.

The judge also supports the incorporation of key material for the investigation into the case by the Prosecutor's Office, remembering that when he is aware of an apparently criminal act, he must carry out the relevant procedures to verify it. Therefore, in his opinion, the Public Ministry followed the "guidelines" established by law in this case.
