The judge presiding over the case of Lindsay Clancy, a woman who killed her three children in the USA in 2023, took the decision to nullify the trial this Friday (4). The jury was unable to form a unanimous opinion regarding Clancy's guilt or innocence, as required by American law.
The development does not exonerate Clancy, who is still a defendant. With the annulment (mistrial, in English), the case goes back to square one: the Prosecutor's Office can choose to resubmit the accusation, with the choice of a new jury, choose to seek a new conviction based on other crimes, or even try to reach an agreement with the accused, avoiding a new trial.
This type of agreement, common in the US, involves a guilty plea in exchange for a lighter sentence. The responsible prosecutor, Timothy Cruz, said that the body will not make any decision in this regard for now — the court scheduled the next session for the 29th.
In the trial that was annulled on Friday, the Prosecutor's Office requested a conviction for first-degree murder, a crime similar to premeditated intentional homicide in Brazil. In the state of Massachusetts, where the trial is taking place, it carries a maximum sentence of life in prison without the possibility of parole.
Clancy's case is one of the most watched in recent times in the USA. The 36-year-old nurse's defense maintained throughout the process that Clancy was under the influence of postpartum psychosis when she strangled her children — Cora, 5, Dawson, 3, and Callan, eight months — and tried to commit suicide in January 2023. She survived, but became a paraplegic.
Throughout the six-day trial, the prosecution tried to prove that Clancy was aware of the seriousness of his actions when he made the decision to kill the children. A psychologist who testified at the Prosecutor's request said he concluded, after examining the nurse, that she strangled her children because she was convinced they would suffer without her.
Furthermore, prosecutors sought to show that Clancy planned the deaths carefully, having asked her then-husband to leave the house to buy food and go to the pharmacy long enough for her to commit the crime.
The defense, in turn, presented testimony from Clancy's ex-husband about the defendant's long-standing mental health problems and highlighted her multiple attempts to seek help — and the different medications she took, including anti-anxiety medications and antidepressants. Her lawyers also drew attention to a statement by Clancy, made days after the crime, in which she said she heard a voice ordering her to kill her children.
After two unsuccessful attempts to reach a unanimous decision, the president of the jury told Judge William Sullivan that the impasse was due to a single member of the panel, further stating that this person was not following the court's instructions on what constitutes "reasonable doubt".
It is an important legal concept in US law according to which, if there is any logical and reasonable doubt about the defendant's guilt, the jury has the obligation to acquit. The way the president informed the judge about the problem — saying that the jury member in question expressed doubt but refused to follow the law — motivated Clancy's defense to ask for the juror's removal. Sullivan denied the motion and then declared a mistrial.
