방송미디어통신위원회는 7일 경기도 정부과천청사에서 제40차 회의를 열고 방송법상 편성위원회 구성 의무를 이행하지 않은 제주방송과 방송편성규약 제·개정을 완료하지 않은 KBS 등 11개 방송사업자에 대한 시정명령을 의결했다.
지난해 8월 개정된 방송법은 방송사업자와 종사자가 함께 참여하는 편성위원회를 두도록 하고 방송편성규약 관련 의무를 강화했다.
방미통위는 올해 5월 관련 규칙을 개정한 데 이어 지난 6∼9월 37개 방송사업자를 대상으로 법적 의무 이행 여부를 점검했다.
점검 결과 37개 사업자 가운데 36개사는 편성위원회 구성을 마쳤으나 제주방송은 아직 구성하지 않은 것으로 확인됐다.
방송편성규약은 26개사가 제·개정을 완료했으며 KBS와 KNN, YTN 등 11개사는 아직 마치지 않은 것으로 나타났고, 제주방송은 편성규약도 제·개원을 완료하지 않았다.
방송법은 지상파 텔레비전 방송사업자와 종합편성·보도전문 방송사업자 등에 편성위원회를 두도록 하고, 종사자 의견을 들어 방송편성규약을 제·개정해 공표하도록 규정하고 있다.
이날 회의에서는 편성규약 제·개정을 위해 노사 협의를 진행 중인 사업자에 대해서는 즉시 시정명령을 내리기보다 추가 기한을 줘야 한다는 의견도 나왔다.
반면 법 시행 이후 상당 기간이 지났고 방미통위가 지속적으로 이행을 촉구했음에도 위반 상태가 이어지고 있는 만큼 시정명령이 필요다는 의견도 제시됐다.
김종철 방미통위원장은 "이미 위반 행위가 있는 상태에서 행정지도를 더 부과하는 것은 적절하지 않다"며 시정명령에 찬성했고, 표결 결과 출석위원 다수 의견으로 시정명령안이 가결됐다.
김 위원장은 "편성위 구성과 방송편성규약 제·개정은 방송 편성의 자율성과 독립성을 실질적으로 보장하기 위해 방송사업자에게 부여된 핵심적인 법적 의무"라며 조속한 이행을 당부했다.
시정명령 이행기한은 오는 11월 7일까지다. 방미통위는 이후 사업자별 이행 여부를 다시 점검해 미이행 사업자에 대해 후속 조처를 할 예정이다.
한편 방미통위는 재허가 조건을 위반한 딜라이브에 대해 부채비율 감소방안 제출·승인 관련 시정명령을 의결했다.
종합편성채널 MBN은 11월 중 재승인 여부를 의결할 계획이며, 기업회생 절차가 진행 중인 JTBC는 6개월 이내 변경된 사업계획을 제출받아 이후 2개월 이내 재승인 심사와 재승인 여부를 결정하기로 했다.
