Decision in the Madencioğlu Apartment case in Malatya: Prison sentence for 5 defendants

In the first of the February 6 earthquakes, Madencioğlu Apartment Building, located on Namık Kemal Street in Yeşilkaynak District of Yeşilyurt district, was destroyed.

A. A., A. A., B. S., F. A., F. A., M. Ç., who were under the rubble. K., M.A., Ö. While K. and S. K. lost their lives, 5 people were injured.

The case regarding the demolition of Madencioğlu Apartment Building was heard and decided at Malatya 1st High Criminal Court.

In court, defendants M.K., M.A., N.S., M.B. and M.H.B. were tried for the crime of "Causing Death and Injury through Conscious Negligence" on the grounds that they acted contrary to their responsibilities and caused the collapse of the building and the death of 9 people.

DEFICIENCIES ARE LISTED IN THE EXPERT REPORT

In the report prepared by the expert panel consisting of experts from Bursa Technical University and Yalova University, it was determined that the earthquake performance of the building was inadequate.

In the report, it was determined that sufficient stirrups and reinforcement were not used in columns and beams, the concrete material was insufficient in terms of strength, an extra normal floor was built contrary to the static project, and there were serious deficiencies in the static calculations.

PRISON SENTENCE FOR 5 DEFENDANTS

As a result of the trial, M. A., who lost his wife and 2 children in the rubble of the building, was sentenced to 10 years in prison, M. K. and N. S. were sentenced to 11 years and 3 months in prison, and M. B. and M. H. B. were sentenced to 8 years, 10 months and 20 days in prison each.

The court also ruled that the travel ban imposed on 5 defendants should continue.
