Minister Gilmar Mendes, of the STF (Supreme Federal Court), proposed to the president of the court, Edson Fachin, that delegates from the PF (Federal Police) be prohibited from working in the magistrates' offices at the court.
The measure had already been defended by the dean since the escalation of the crisis between minister André Mendonça and the general directorate of the PF. It gained strength after the Master's rapporteur exposed conversations between former banker Daniel Vorcaro and STF minister Alexandre de Moraes.
According to the STF's transparency portal, six PF delegates are currently assigned to the Supreme Court: two with Mendonça in the Master and INSS (National Institute of Social Security) cases, two with Moraes himself, one in Minister Luiz Fux's office and one more who works in the security area.
Fux, however, states that he does not have delegates on his team, although the STF system cites the name of Fabiano Emidio de Lucena Martins as assigned by the PF to his office since May 18, 2026, with in-person work.
The STF reported, in a note sent on Tuesday night (3), that Fabiano's name appeared in the system "due to a technical inconsistency in the personnel registration system".
"The only delegate whose name was linked to the Cabinet of Minister Luiz Fux did not take office in the body. It should be noted, therefore, that there is no delegate designated or working in that office, stated the STF.
The court also reported that the technical failure was resolved and the information in the system was updated, without any delegate being present in Fux's office.
Gilmar told assistants that PF delegates who work alongside STF ministers could end up interfering in the conduct of investigations, with the aim of gaining new positions in the category or obtaining some political benefit.
The delegates assigned by the PF to the offices do not act as investigators, but as advisors to the ministers. Based on their expertise in criminal investigation, they can assist in the technical analysis of criminal procedures, reports and requests for due diligence made by the corporation.
The federal police officers responsible for conducting the investigations themselves — such as the Master, the INSS or criminal inquiries into parliamentary amendments, for example — do not work within the Supreme Court's offices. They stay in the PF itself.
The ADPF (National Association of Federal Police Delegates) classified Gilmar's initiative as ''regrettable''. The entity says that specialized assistance is useful so that ministers have "support in a better understanding of the aspects that permeate a police investigation".
"Certainly the current problems of the Supreme Court are not the responsibility of the Federal Police delegates, neither inside nor outside the police. Perhaps demonizing them is just the easiest way to take the focus away from the problems that really deserve a solution", says the president of ADPF, Edvandir Paiva.
In June, the Lula (PT) government sent letters to more than 50 public administration bodies asking for seconded federal police officers to be "returned" to their original posts. The Supreme Court, however, was spared.
The dean already spoke with Fachin about the topic on another occasion, around two weeks ago, and should raise this issue again this Thursday (3). Both must meet to discuss the unprecedented crisis experienced by the court, which for the first time will deliberate whether or not to open an investigation against a colleague.
Fachin has sought out magistrates for individual conversations. The STF president's assessment is that the situation is unprecedented and must be treated with the utmost caution, aiming to preserve the institution.
As Folha showed, a minister even warned Fachin about the possibility that Mendonça was being influenced by the delegates in his office, who are critical of the stance of the PF director general, Andrei Rodrigues.
The rapporteur for No Discount and Zero Compliance operations, on the other hand, tells people close to him that he acts with caution and independence and that his main objective is to guarantee the integrity of investigations, respecting due legal process.
The wing that defends Moraes understands that Mendonça overrode the rites by ordering the PF to investigate a STF minister in spite of a prior decision by the plenary, as required by the rules. This group compares the rapporteur's methods with those of Operation Lava Jato and prepares an offensive to expose these weaknesses.
The meeting between an assistant judge from Mendonça with Vorcaro without the presence of the PF, Mendonça's participation in the corporate structure of Instituto Iter (from which he announced his departure this Thursday) and alleged leaks of confidential information should be included in the list of allegations of the "counter attack".
