The Public Ministry filed an appeal this week to increase the prison sentence of Denis Cipriano de Carvalho Silva, convicted of pushing his girlfriend Gabriele Gonçalves out of a moving car, in Cajuru (SP), but released after the trial.
Initially taken to jury for attempted feminicide, Silva ended up released after jurors concluded that he had no intention of killing and downgraded the charges against him to serious bodily injury and failure to comply with a protective measure.
As a result, the sentence was established at three years and six months, in an open regime and less than four years, which allowed him to appeal freely.
In the appeal presented to the São Paulo Court of Justice (TJ-SP), prosecutor Marco Thulio Gonçalves asks that Silva be sentenced to six years and eight months.
He argued that the calculation of the penalty, in the first instance, was based on a minimum of one instead of two years in prison, even in the case of an injury committed in the context of domestic violence.
Furthermore, according to him, the sentence was increased by only one-sixth even though there were different unfavorable circumstances, and even with the sentence itself recognizing the gravity and cruelty of the facts.
To g1, Silva's lawyer, Mauricio Ferraz, informed that the jury's decision partially corrected an immense injustice that the defendant had been suffering and that he completely disagrees with the MP. He also reported that he filed an appeal, asking for the accused to be acquitted for both crimes or for the sentences imposed to be reduced.
"The intention to increase the sentences is unreasonable, completely unreasonable. Evidently, the intention is to impose deprivation of liberty on the accused by increasing the sentences under weak arguments that will be duly contradicted by the defense", he informed.
Pushing a moving car
The attacks against Gabriele occurred in January 2025, on Rua Capitão José Ferreira Diniz, in the center of Cajuru.
According to the Public Ministry, investigations showed that the couple had argued during the "Festa de São Sebastião", a traditional event in the city, and Gabriele decided to walk home, but her boyfriend followed her until he found her.

According to the Prosecutor's Office, in addition to being punched in the eye, the woman was pulled by her hair and forced to get into his car, where she continued to be attacked.
The victim reported that, to try to escape the attacks, he tried to get out of the vehicle, but realized he couldn't because it was moving. She started shouting for help until she caught the attention of people on the street.
According to Gabriele, after several attempts, she managed to open the car door and ended up being thrown out by her boyfriend.
The Prosecutor's Office recorded in the complaint that, after being thrown from the moving vehicle, Gabriele was dragged a few meters by the attacker's car, because her foot had become stuck in the car seat.
Then, according to the MP, the suspect stopped the car, got out and grabbed his girlfriend in an aggressive manner.
Gabriele was rescued with the help of witnesses and initially taken to Santa Casa de Cajuru, from where she was transferred to Hospital das Clínicas (HC) in Ribeirão Preto due to the severity of her injuries.
