MPE calls for the impeachment of Roberto Cidade and a fine for the first lady for promotional use of social programs

According to the MPE, Roberto Cidade participated in the delivery of free benefits, such as glasses, assistance cards, helmets and tools, in addition to sharing images of the actions on his personal profile on social media. The body also defended the imposition of a fine on first lady Thaísa Coelho Cidade.

In the request made to the Court, Cidade's defense claimed that the Public Electoral Ministry presented an opinion before the end of the evidence production phase and requested that the document be considered null.

The judge, however, understood that there was no harm to the defense and stated that the opinion will only be analyzed when the investigation phase of the case is completed.

In the opinion, regional electoral prosecutor Valdir Monteiro Oliveira Júnior states that the evidence gathered in the process indicates the practice of prohibited conduct provided for in article 73, item IV, of the Elections Law, which prohibits the promotional use of social programs by public agents in circumstances that may affect equal opportunities between candidates.

In the document, the prosecutor states that the conduct of the governor and candidate for re-election, when participating in the delivery of items in a program of the Government of Amazonas, represents "a blatant affront to the principle of impersonality".

In the decision, the judge also postponed the analysis of requests for the production of evidence made by the defenses. Before that, the coalition that filed the action must present a response to the objections and documents presented by those being investigated.

The judge also ordered the end of the judicial secrecy of the process and established a deadline of two days for the coalition to present the reply. After this stage, the process returns to the judge for analysis.

The MPE's opinion cites events held between May and July this year, in Manaus and in municipalities in the interior of Amazonas. For the MPE, the governor's participation in deliveries, the highlighting of his image during events and the dissemination of actions on personal profiles characterize the promotional use of social programs to benefit the candidacy.

Based on these arguments, the Public Electoral Ministry requested the imposition of a fine of the maximum amount provided by law and the revocation of Roberto Cidade's candidacy registration.

In relation to Serafim Corrêa, the request for revocation arises, according to the opinion, from the principle of the uniqueness of the ticket. The MPE did not ask for a fine from the candidate for vice-governor, as it understood that there was no proof of his participation in the actions.

The Public Electoral Ministry also requested the imposition of a maximum fine on First Lady Thaísa Coelho Cidade, named in the opinion as a public agent for serving as honorary president of the Social Promotion and Poverty Eradication Fund (FPS). According to the agency, she participated in the delivery of benefits and publicized the actions on social media.

On the other hand, the MPE asked for the representation to be dismissed in relation to the other people being investigated, including state secretaries, state deputies and the mayor of Careiro, Mara Alves. According to the opinion, sufficient evidence was not presented that they had practiced or permitted the promotional use of public benefits in favor of the candidacy.
