The Operation Bluebird Twitter case brought about an important legal process in the social media world. X Corp. In the ongoing trademark case with , the federal court in Delaware announced a critical interim decision.
The court temporarily blocked the startup from using its Twitter name. However, X's request for the Tweet brand and Twitter's old bird logo was rejected.
Operation Bluebird changed the name of the platform after this development. The new social network now continues under the name Tweet.app.
Court Decision and Trademark Rights
Operation Bluebird filed applications with the US Patent and Trademark Office in December 2025, arguing that the old Twitter brand had been abandoned by X. The startup launched the platform under the name Twitter.now at the end of August, without waiting for the final decision from the court.
X Corp. filed a lawsuit stating that Twitter-related brands were under its ownership. X's request was partially granted in a 31-page interim decision issued by Delaware District Court Chief Judge Colm F. Connolly on September 3.
The court ordered Operation Bluebird to cease use of eight trademarks containing the Twitter name. However, the same measure was not applied to the Tweet brand and bird logo.
In the part of the decision regarding the Twitter name, the description of the X application in the Apple App Store was decisive. X still uses the phrase “Welcome to X (formerly known as Twitter)” in the app description.
X Corp. Legal director Naser Baseer stated that this statement was added so that users can find application X. The court evaluated this statement as taking advantage of the awareness created by the Twitter brand.
For this reason, it was ruled that it could not be proven that X abandoned the Twitter-related word marks. X also continues to hold the twitter.com domain name.
Rights on Tweet and Bird Logo
The situation is reversed for the word Tweet and the old bird logo. When rebranding Twitter as X in July 2023, X removed the Tweet emoticon and bird logo from the platform's main interface.
Court records confirmed that these two marks were not included on X's homepage. There were no sufficient examples of the current use of Tweet or bird logo on X's blog page.
X argued that old brand elements were found in some supplier documents and old websites. The court considered these examples to be remnants of past use remaining on the Internet.
The fact that old pages were not removed or that old application versions were found on some devices was not considered sufficient to prove that commercial use continued. The statements made by Elon Musk in July 2023 were also evaluated.
At that time, Musk announced that they would say goodbye to the Twitter brand and the birds. The court accepted these statements as strong evidence that X had no intention of reusing the Tweet brand and bird logo.
The injunction requested by X for these two brands was rejected. The decision only covers interim measures during the ongoing litigation process.
Tweet.app and Early Access Process
Following the decision, Operation Bluebird dropped the Twitter name and rebranded the platform under Tweet.app. Company President Stephen Coates evaluated the decision as X protected the word Twitter, but could not take precautions on the bird logo and the word tweet.
The court decision dated September 3 is also included on the Tweet.app website and states that X Corp. It is clearly stated that there is no connection with. The account ranks and usernames of people who previously requested usernames for the platform have not changed.
Operation Bluebird announced that more than 172 thousand people requested a username before the rebranding. Tweet.app is currently running an early access system and using a paid membership for entry.
Basic Founder membership is set at $20. This package includes early access, username, sequence number and profile badge.
Those who pay at least $40 get Fighter status. The platform does not define these payments as shares or investments and does not give users the right to financial returns.
Tweet.app's website is active, but the social network has not yet been opened to full public use. The platform's trust system, VERA, and Trust Dial features, where users can determine what to see in their streams based on the trust score of the content, are not yet active.
