Selon les magistrats, le malaise d’un passager nécessitant son débarquement « n’est pas inhérent à l’exercice normal de l’activité » d’une compagnie aérienne. Air France ne disposait par ailleurs d’« aucun moyen de l’éviter » et avait acheminé la voyageuse à destination « dans les meilleurs délais ». Le malaise constitue donc, dans ces circonstances, un événement extraordinaire exonérant le transporteur de son obligation d’indemnisation.

La décision ne signifie pas pour autant que tout incident médical permette automatiquement à une compagnie d’écarter une demande de compensation. Celle-ci doit notamment pouvoir démontrer que l’événement échappait effectivement à son contrôle et qu’elle a pris les mesures raisonnables pour limiter les conséquences du retard.
