MV Judges' Association files a constitutional complaint regarding pay

The Mecklenburg-Western Pomerania Judges' Association has filed a constitutional complaint against the state's salary policy with the Greifswald State Constitutional Court. The association explained that the current remuneration was no longer up to date and unconstitutional. The demand: better pay for judges and prosecutors in the country.

Despite multiple indications and constructive suggestions, the state government has not taken any concrete steps, the judges' association alleges. “The chosen delaying tactic sends a fatal signal, will be expensive for the country, will cost qualified young talent and will lead to growing dissatisfaction in the judiciary.” The association therefore felt compelled to appeal to the Constitutional Court. The board is available at any time for constructive and binding discussions.

Judgment of the Federal Constitutional Court

The background to this is, among other things, a decision by the Federal Constitutional Court in September 2025, according to which civil servant salaries in Berlin were unconstitutional for years, with a few exceptions. This also has an impact on other federal states and the federal government. Some state governments have already initiated implementation. In MV, too, many of the almost 30,000 active and retired civil servants could receive more money. According to the ministry, there are around 600 judges and prosecutors in the country.

Ministry rejects criticism

The Ministry of Finance and Digitalization, the German Trade Union Federation (DGB) North and the civil servants' union dbb had already rejected the accusation of playing for time on Thursday. There has been a clear understanding for months about adjusting salaries. “We announced early on that we wanted to continue discussions on the further development of salary law after the state elections and come to an agreement,” said Finance and Digitalization Minister Heiko Geue (SPD). A new state parliament will be elected in MV on September 20th.
