Rapper Dzhigan (real name Denis Ustimenko-Weinstein) will be tested for intoxication, and qualifications will depend on the results of the examination, said lawyer Andrei Nekrasov. He gave a comment to Lenta.ru.

“I would start with whether there are aggravating circumstances here, because I’m not sure that a person who is not in a state of intoxication can do something like this. I think, first of all, they will now check him for this condition. In fact, what he did will be classified by the investigative authorities. Witness testimony and examinations that will be carried out are very important, because you can shoot in very different ways,” Nekrasov said.

According to the lawyer, if it is established that Dzhigan shot to kill and aimed at a vital organ, then we can talk about attempted murder. In any case, according to him, this is a deliberate attempt to cause harm to health, and the degree of severity will be determined by an examination.

“As for everything else, this can at least qualify as deprivation of liberty of a specific person. Then, in the worst case, maybe it was torture, bullying. Well, then there are different signs: from hooligan motives, due to personal hostility, and some other circumstances,” Nekrasov noted.

According to the lawyer, such a media character is unlikely to avoid real imprisonment.

If Dzhigan already had a criminal record, the court will consider this not in his favor, the lawyer emphasized. In addition, it will not be possible to reconcile and repair the damage in such a situation, since the matter is of a public nature.

“He will not escape his responsibility to society and the state. At a minimum, what I have named will definitely be presented to him. The case is high-profile, and if it has already received publicity, then it will not be possible to simply forget all this,” added Nekrasov.
