A man surnamed Gao in Keelung started dating a girl in 2019 and asked her to sign a love contract and agreed that as long as the girl broke the contract, she must have sex with him. After the girl violated the rules, Gao Nan took the girl to hotels, public toilets, etc., and had sex 20 times; and as long as the victim girl did not cooperate, Gao Nan would open a "doppelgänger account" and pretend to be someone who wanted to harm the girl, sending messages such as "That person will come to your house the day after tomorrow." "I said they can investigate you or kill you" and other messages to intimidate the other party and threaten the girl to agree to have a relationship. After interrogation, the prosecutor determined that the evidence of Gao Nan's crime was clear, and that he had committed 20 times of forced sexual intercourse and 1 crime of intimidation and endangering safety. He initiated a public prosecution in accordance with the law and asked the judge to discuss and punish him.

Lawyer Fang Yanhui pointed out that any signed contract is invalid as long as it violates public order, good customs and mandatory regulations. The contract in the case stipulated that "no contact with the opposite sex" and "sex shall occur upon breach of contract" and other clauses, excessively restricting personal freedom of making friends, and using sexual autonomy as the subject of punishment for breach of contract, which obviously violates the general interests of society and moral concepts. According to Article 72 of the Civil Code, legal acts that are contrary to public order or good customs shall be invalid.

In addition, the "otherwise life safety may be endangered" in the contract is a threat to harm the legal interests of life. According to Article 71 of the Civil Code, it violates mandatory or prohibited provisions, and the agreement is invalid according to law. According to the previous paragraph of Article 111 of the same law, if part of a legal act is invalid, the entire legal act is invalid, so the contract has no binding force at all.
