A man surnamed Lin has been absconding from China for many years and spent NT$550,000 to smuggle back to Taiwan. He was caught by security and escaped. The three accomplices were sentenced to six to one year in the first trial. The prosecutor's appeal was rejected.

A man surnamed Lin was implicated in the case and fled China for many years. In order to return to Taiwan, he spent 550,000 yuan to find a smuggling syndicate. He sailed a Chinese fishing boat to the high seas to pick up the hidden cabin and took him back to Penghu. Lin then took someone else's ID card and prepared to take a boat back to Chiayi. However, he was caught by security and escaped. In the first instance, he sentenced three co-conspirators to six months to one year in prison for violating the Immigration and Immigration Act. The prosecutor refused to accept the appeal.

The verdict pointed out that in July 2023, a wanted criminal surnamed Lin who fled to the mainland due to the case (a separate case was tried) contacted a man surnamed Xu living in Penghu and arranged for him to be smuggled back to Taiwan at a high price of 550,000 yuan. Xu Nan asked friends surnamed Wang and Yu to assist. Wang Nan first contacted the Chinese captain "Diao" to take Lin Nan to the designated sea area, and then Yu Nan drove the fishing boat to the high seas to rendezvous.

Lin Nan was stuffed into the cabin of the fishing boat to avoid detection, and successfully drove into Magong Fishing Port to declare customs and enter the port. Later, Wang Nan drove to pick him up. In the names of Wang and Xu, Lin Nan was arranged to stay in two hotels in Penghu and hide. In order for Lin Nan to return to the island smoothly, Wang Nan handed his national ID card directly to Lin Nan and asked him to buy a passenger ferry ticket to Budai Fishing Port in Chiayi. Unexpectedly, when Lin Nan was preparing to board the ship on August 5 of the same year, he was noticed by the coast guard security inspector because of his abnormal expression. Lin Nan felt guilty and "abandoned the ship" and fled the scene in Xu Nan's vehicle.

After receiving the report, the task force launched a search and successively arrested three members of the human smuggler group, including Wang, Yu and Xu. In the first instance, they were each sentenced to prison terms ranging from 6 years to 1 year. The prosecutor refused and filed an appeal. They believed that smuggling was "highly profitable and low-risk" and the original sentence was too light. They requested that Yu and Xu be sentenced to a heavy sentence of more than 3 years and 6 months.

However, the second-instance collegial panel believed that the first-instance had fully considered the living conditions of Yu Nan running boats and Xu Nan selling garbage bags, as well as their respective division of labor and their attitude of confessing their crimes. The sentencing did not exceed their discretion and rejected the prosecutor's appeal. The whole case can still be appealed.
