Bihar Police's ADG Law and Order KS Anupam has confirmed the arrest of the main accused Nandan Yadav in the Jamui sexual violence case.
He told news agency ANI that SIT has been formed in this case in which charge sheet will be filed soon for speedy trial.
Jamui SP Vishwajit Dayal has said that a total of five people including the main accused have been arrested in this case and three people have been detained for sharing the video.
Also, ADG Law and Order KS Anupam has said that a case has been registered against those who have made the video of sexual violence against minor children viral, under the Protection of Children from Sexual Offenses (POCSO) Act.
He said that making and circulating such videos of children is a non-bailable offense under the POCSO Act and action will be taken against whoever shared it.
The main accused Nandan Yadav has been arrested after the encounter.
On the question of encounter, KS Anupam told news agency ANI that the main accused had a pistol and he had fired first, after which the police had to open fire.
On Monday, a video from Jamui district of Bihar went viral on social media in which a mob surrounded two minors in the middle of the road and subjected them to violence and sexual assault.
The police have clearly said in this matter that along with the accused in this case, action will be taken against those who have made this video and shared it on social media.
So if Jamui's video has appeared in your social media feed and you have also shared it, then be careful. Delete that post and before sharing any such video in future, consider that police action may also be taken.
Jamui Police has appealed not to post, share or forward the video related to the minor survivor, citing that her identity is not public.
Jamui Police has said in its X-post, "The case of revealing the identity of a minor will fall under the criminal category under POCSO including Indian Judicial Code 2023, IT Act 2000 and JJ (Juvenile Justice) Act. There is a provision of strict punishment for those who do so."
Jamui Police has registered an FIR in the sexual violence case under sections 74 (outraging the modesty of a woman), 76/3(5) (disrobing a woman) of the Indian Penal Code and section 08/12 (sexual harassment of children) of the POCSO.
Jamui Police SP Vishwajit Dayal said in the statement that the viral video being made on social media is a crime under Section 23 of the POCSO Act, IT Act and Section 74 of the Juvenile Justice Act.
He said, "Under this, an FIR has been registered in the cyber police station against 120 social media account users. There is an appeal to everyone to take care of the privacy of the minor victim and not to make such videos viral."
Jamui's case is related to a minor, so a case has been registered under Section 23 of the POCSO Act for making the video of this case public.
Under this section, the identity of the minor and his parents cannot be revealed. There is a provision for punishment for violation under Section 23 of the POCSO Act.
According to Section 23 of the POCSO Act of 2012, no person shall make any report or comment about a child through any media, studio or photography facility which may damage his reputation or violate his privacy, unless he has complete and accurate information.
No such report will be given in any media which would reveal the identity of the child, such as his name, address, photo, family information, school, neighborhood or any other information… which could reveal the identity of the child. Provided that the Special Court hearing the case under this Act may, for reasons to be recorded in writing, permit the disclosure of such information if in the opinion of the Court it is in the interest of the child to do so.
Publishers or owners of media, studios or photography facilities shall be jointly and severally liable for the acts and omissions of their employees.
Whoever contravenes the provisions of sub-section (1) or sub-section (2) of section 23 shall be punished with imprisonment of either description for a term which may extend to six months to one year, or with fine, or with both.
Whereas Section 74 of the JJ Act deals with the protection of confidentiality of identity and self-respect of children who have committed a crime, who are in need of protection, who are victims or witnesses.
This section completely prohibits making public the personal information of children involved in any case.
There is a provision for a jail sentence of up to six months and a fine of up to Rs 2 lakh for its violation.
Political statements are coming on this matter. Politicians from Bihar and the country including the National Commission for Women have become active on this issue.
Jamui Police has said many times that it is trying to remove this video from social media and is trying to ensure that the video is not uploaded or shared again from any other account.
Police say that the social media accounts that made the video viral and circulated are also being investigated. According to the police, action will be taken against those whose role will be revealed under the law.
Bihar's ADG Law and Order KS Anupam also held a press conference in which he said that if anyone shares the viral video without blurring the girl's face, a case will be registered under POCSO.
Police have identified many accounts and have also sent takedown notices.
Jamui SP Vishwajit Dayal had told the media on Monday that the viral video is of 7 pm on September 19.
In the viral video, minor students are sitting on a scooter and a crowd of youths have surrounded them.
During this time the student is being sexually harassed. The same student is trying to save the girl from the group of youth.
Bihar Police's ADG Law and Order KS Anupam has said in this matter that "The minor girl had gone to take photographs with her friend, some people living in that village molested the girl."
