The lawyer explained what payments employees are entitled to upon dismissal

MOSCOW, June 27 - RIA Novosti. Upon voluntary dismissal, an employee is entitled to payment for days actually worked and compensation for unused annual leave, lawyer and retired lieutenant colonel of the internal service Elena Brown told RIA Novosti.

The agency's interlocutor stated that in accordance with Article 140 of the Labor Code of the Russian Federation (Terms of payment upon dismissal), upon termination of an employment contract, the employer must make a full settlement with the employee on the day of dismissal.

“Payment for actually worked days in the month of dismissal (wages), including bonuses, allowances and additional payments provided for by the internal documents of the enterprise, as well as compensation for unused annual leave - basic and additional - are due to the employee upon dismissal of his own free will,” Brown said.

She added that the same payments are due to an employee upon reduction and dismissal by agreement of the parties.

Also, if the staff is reduced or the organization is liquidated, the employee, in accordance with Article 178 of the Labor Code of the Russian Federation (Severance pay. Payment of average monthly earnings for the period of employment or one-time compensation), in addition to mandatory payments, must receive severance pay - an additional payment for material support of the employee due to loss of work - in the amount of the average monthly earnings, and also, in the case of looking for work, the average earnings for the period of employment for the second month after dismissal, the lawyer clarified.

“Also, severance pay for seasonal workers is paid in the amount of two weeks’ average earnings, and for those working in the Far North, average earnings can last up to 6 months,” Brown noted.

According to her, upon dismissal by agreement of the parties, in accordance with clause 1 of part 1 of Article 77 of the Labor Code of the Russian Federation, payment of severance pay is not mandatory, but is possible by agreement of the parties and indicated in the agreement on termination of the employment contract. At the same time, the amount of such compensation is not limited, except for certain categories of employees - managers and chief accountants of government agencies - and dismissal can be formalized at any time without mandatory two-week work, the lawyer added.
