最後,我們想提出一個假設:「如果今天完全相同的事情發生在台灣呢?」一名住在台灣的人,接受中國指示去跟蹤了某位政要的親屬,拍攝他的住宅、車牌、家庭與紀錄生活軌跡,隨後再把資料交給中國政府。在法律上他似乎沒有直接竊取國家機密,沒有發展組織,也沒有收買公務員,更沒有介入選舉。那麼,台灣檢方應該用哪一條法律追訴?台灣當然不是沒有國安法律。我們有《國家安全法》、《國家情報工作法》、《反滲透法》,跟蹤行為本身在特定情況下也可能涉及其他法律。但台灣是否存在一個與美國 951條相近、可以直接處理「秘密接受外國政府指揮而在境內活動」的法律,這就是另一個問題。台灣法律不一定抓不了,但我們需要更明確界定:這類行為是否涉及國家安全?哪些的資料蒐集又算是機密?當現代情報工作不再只是偷國家機密,而可能是蒐集住址、車牌、人物關係與生活軌跡、甚至包括行為模式時,台灣現行的反情報相關法律,是否足以應對?
總統府表示,我國對這類傷害主張自由民主人士或其家人的野蠻行徑,表達最嚴厲譴責。
