The U.S. state of Florida requests a court to ban OpenAI from developing new AI models without independent oversight.

Florida Attorney General James Erthmire announced on the 28th (local time) that he had submitted an application for a temporary order with the following contents to the state court.

In an application for a temporary injunction submitted on this day, the State of Florida claimed, "The defendant (Open AI) admitted that its service poses an existential risk that threatens the survival of humanity," and added, "They asked the government to tie themselves to the mast."

He continued, “Unless the court stops it, immediate, substantial, and irreparable damage will occur,” and demanded that the court take urgent action.

In today's application, the state of Florida requested that OpenAI not develop any AI models without safeguards and approval from an independent third party.

In addition, we requested that the provision of ChatGPT to minors in the state of Florida be prohibited and that OpenAI be prohibited from collecting and processing personal information of minors under the age of 13 without prior warning and consent.

The application for this temporary injunction was filed to prevent damage that may occur while the lawsuit previously filed by the state of Florida against Open AI is pending.

The state of Florida filed a lawsuit against OpenAI and CEO Altman in June, claiming that OpenAI violated state fair trade laws by ignoring safety warnings and launching the ChatGPT service without sufficient safety measures, causing harm to children.

Separately from this lawsuit, Florida prosecutors have begun an investigation into OpenAI in connection with allegations that the suspect in the Florida State University shooting incident in April that killed two people and injured six others received significant advice through ChatGPT before committing the crime.

Meanwhile, OpenAI spokesperson Drew Pusateri said in a statement that the company had paused training of its highest-performing models and would not resume training until additional safeguards were in place.

“Government has an important role to play in establishing strong safety standards for AI,” he said. “We will work with Florida and other states to advance practical AI policies that apply to the entire AI industry, not just one company.”

The Wall Street Journal (WSJ) reported on this day that OpenAI withdrew the launch of its next-generation model, 'GPT-6.1 Astra', due to safety concerns. The model failed to meet safety standards in internal testing before launch, the newspaper said.
