The Russian Ministry of Internal Affairs ordered to study the position of the Constitutional Court on violation of traffic rules in extreme necessity

The Russian Ministry of Internal Affairs has instructed to study and take into account the position of the Constitutional Court that violation of traffic rules in cases of extreme necessity is not a criminal offense.

Representative of the Russian Ministry of Internal Affairs Irina Volk noted that in practice there are often cases of accidents in which a driver who violated traffic rules created a danger for other road users, but did not collide with them.

In such situations, there cannot be a predetermined culprit for the accident, and the actions of each driver are subject to careful investigation and legal assessment.

The Russian Ministry of Internal Affairs has been instructed to study and take into account the position of the Constitutional Court, according to which violation of traffic rules in case of emergency is not a criminal offense, said official representative of the Russian Ministry of Internal Affairs Irina Volk.

“In August of this year, the Investigation Department of the Ministry of Internal Affairs of Russia instructed the heads of subordinate units to study and take into account in their official activities the position of the Constitutional Court, according to which there are no signs of criminal wrongfulness for a violation of the Traffic Rules that entailed the infliction of consequences through negligence... if such an act was committed in conditions of extreme necessity,” Volk wrote in a channel on the Max platform.

An official representative of the Ministry of Internal Affairs explained that in practice there are often cases of accidents in which the vehicle of the driver who violated the traffic rules did not directly collide with other vehicles, pedestrians or other objects, but created a danger for vehicles that have the right of way.

For example, Volk noted, we are talking about situations where one driver creates a dangerous situation on the road, and the other, trying to avoid a collision, commits a forced violation of the rules and commits an accident with serious consequences.
