Hsinchu prosecutors and police discuss election deepfake video and disinformation case handling mechanism

The year-end general election is the first time in the history of our country's democratic elections that a large number of AI elections have been introduced. In order to prevent the rapid spread of deep fake videos and false information from affecting the Hsinchu election, the Hsinchu District Prosecutor's Office recently invited the heads of police investigation units in Hsinchu County and City to gather together to discuss and set the tone. If such a case is encountered, how to divide the work and respond to clarify the case as soon as possible and minimize the negative impact.

The meeting, titled "Discussing the handling mechanism for election deep fake videos and false information cases," was mainly aimed at clarifying the case handling process and division of labor. It was chaired by Prosecutor General Ke Yifen, and high-level officials from the Hsinchu County and City Investigation Stations and Police Stations personally participated in the discussion.

During the meeting, the procuratorate, police and police dispatched their respective personnel to explain relevant laws and regulations and practical insights, case acceptance and evidence preservation procedures, division of labor among specialized units, and procedures for submitting forensic evidence, etc. County Police Chief Lin Jianlong specializes in cyber crime investigation, digital forensics and information security incident investigation, so he is specially chosen to share his practical experience in forensics for reference by other units.

In addition to exchanging views on details such as the verification of deepfake audio and video cases, the time required for forensics, and inter-agency liaison, the participants also discussed in depth the application and diversion of procedures such as application for forensics by candidates specified in Article 53-1 of the Public Servant Election and Removal Act, request for removal by parties involved, prosecutorial and police notification platforms, and suspension of analysis.

Ke Yifen said that the verification, identification and handling of deepfake video and disinformation cases are time-sensitive. Each agency should first clarify its own acceptance, submission for forensics and follow-up processing procedures, so that front-line colleagues can correctly secure evidence, report and triage when they encounter a case. In order to avoid missing out on the control and processing at the beginning of the acceptance, it will require repeated corrections or referrals in the future, consuming investigative manpower and time, and may also crowd out the investigation capacity of other cases that interfere with elections, such as vote bribery and violence. Therefore, all units participating in the meeting are required to clarify the division of labor and procedures so that the case can be handled in a timely and appropriate manner.
