Defense of former INSS president appeals to the STF against preventive detention of more than 300 days

The defense of former INSS president Alessandro Stefanutto appealed to the presidency of the STF (Supreme Federal Court) against his preventive detention, which has already lasted more than 300 days.

The lawyers filed a habeas corpus alleging that the rapporteur, minister André Mendonça, did not analyze the previous requests. According to the defense, since November 2025 four requests have been made to revoke or review the prison.

The last of them was at the beginning of this month, after Mendonça relaxed precautionary measures against others investigated in INSS fraud.

For Stefanutto's defense, the foundations of the rapporteur's other decisions also apply to the former president of the INSS, as it is the same investigation and, in this case, the same factual core.

Furthermore, the lawyers argue that the final report of the investigation was presented in August and that the justification for maintaining the prison, that of preserving the investigations, has lost its basis.

The habeas corpus filed by lawyers Fabrício Reis Costa and Júlio César de Souza Lima also states that the last accusation made against the former manager would have occurred in September 2024.

In the piece, they argue that in more than 500 days of investigation, no financial elements were identified that demonstrated Stefanutto's link with the resources under investigation.
