Karaca from EMEP brought to the Parliament the workers who were not reinstated despite the decision to reinstate them in Tunceli Municipality.

EMEP Gaziantep Deputy Sevda Karaca submitted a motion to the Presidency of the Turkish Grand National Assembly and asked the Minister of Labor and Social Security, Vedat Işıkhan, about not reinstating the 13 workers who were dismissed after the appointment of a trustee to Tunceli Municipality and whose reinstatement was finalized by the court decision.

In his motion, Karaca stated that after a trustee was appointed to Tunceli Municipality, a total of 13 people were dismissed, 9 workers on December 31, 2024, and 4 workers on March 24, 2025.

Stating that the local court gave a reinstatement decision in the cases filed by the workers, Karaca noted that the appeal application of the trustee management was also rejected by the 6th Civil Chamber of the Erzurum Regional Court of Justice and the local court's reinstatement decision was definitely approved.

Karaca stated that despite the judicial decision and the long period of time that has passed, the court decisions have not been implemented, and stated that in accordance with Article 138 of the Constitution, the legislative and executive bodies of the municipality and the administration are obliged to comply with the court decisions.

"TRUSTEE REGIMES CONTINUE TO USUR THE RIGHTS OF WORKERS"

Arguing that workers' right to work has been taken away from them through arbitrary practices and that they have been condemned to hunger and insecurity along with their families, Karaca said, "Constitutionally guaranteed judicial decisions are clearly being violated. Although it is a Constitutional obligation to carry out public services without interruption and ensure job security, the trustee regimes appointed to local governments continue to usurp the rights of workers with arbitrary dismissals, deunionization and massacres of workers."

Karaca included the following questions in his preamble:

"-What is the reason why 13 workers, who were dismissed by the trustee administration in Tunceli Municipality and whose reinstatement was finalized by the decision of the Erzurum Regional Court of Justice, were not reinstated despite the court decision?

-Is there an investigation or investigation initiated by your Ministry or the relevant authorities against the trustee management of Tunceli Municipality and those responsible for not implementing the final judicial decision in violation of Article 138 of the Constitution?

-Will the compensation, delay interest and other public damages arising from the workers not being reinstated despite the reinstatement decision be recourse to the trustees and municipal managers who did not implement the decision? Who will bear the public damage?

-How many labor inspectors has your Ministry assigned to address arbitrary dismissals, de-unionisation pressures and non-implementation of judicial decisions in municipalities where trustees have been appointed? What are the results of the inspections?

-How many workers have been laid off in municipalities under trustee management in the last 3 years?

-Is there any concrete step or schedule that your Ministry will take to prevent the loss of rights of workers who are victimized as a result of the failure to implement judicial decisions by the administration and to ensure immediate job security?
