Former attorney Deltan Dallagnol presents documents with fiscal secrecy from minister Cristiano Zanin to the Electoral Court

Former attorney Deltan Dallagnol (Novo-PR) presented documents relating to the tax and banking secrecy of STF (Supreme Federal Court) minister Cristiano Zanin in his candidacy registration for the Electoral Court.

Deltan included in the TSE (Superior Electoral Court) system copies of processes of which he was the target of the CNMP (National Council of the Public Ministry). In the files, there are documents from the Federal Revenue Service with information about the income and bank transactions of Zanin and his wife, Valeska, protected by tax secrecy. The information was initially published by the Metrópoles portal and confirmed by UOL.

Zanin had his confidentiality broken by federal judge Marcelo Bretas in 2019, during Operation Lava Jato. At the time, he was a lawyer for Fecomércio-RJ, accused of embezzlement of public resources. The decision to breach confidentiality was later annulled by the STF, as were the documents obtained as a result of the measure.

In a statement, Deltan said that he presented the documents to contest the requests to challenge his candidacy for the Senate. "Among these processes is the disciplinary complaint filed by Zanin against Deltan and other prosecutors, which was thousands of pages long. The then lawyer's tax and banking details were included as part of this complaint," he said.

According to the press office, copies of the processes were presented in full "so as not to omit any data or information" and "to fully exercise the political right of candidacy, fully demonstrating your eligibility". He states that he never "intended to expose data" about the judge.

Zanin asked for action. In a letter sent to the Electoral Court, the minister requested "due communications with a view to holding those involved accountable, including in criminal matters."

After that, the president of the TRE-PR (Paraná Regional Electoral Court) imposed secrecy on the documents. Judge Luciano Carrasco Falavinha Souza also gave the candidate 24 hours to explain what happened. UOL verified that the content is no longer public on the systems.

In a note, TRE-PR informed that it forwarded the incident to the Public Ministry for the appropriate measures. "TRE-PR also emphasizes that the protocol of documents in the Electronic Judicial Process system (PJe) is carried out by the parties' own lawyers, who are responsible for granting secrecy to the attached documents."

Deltan was elected federal deputy for Podemos in 2022, but had his candidacy registration revoked by the TSE the following year. The court understood that he left his position as prosecutor at the Federal Public Ministry while still responding to disciplinary procedures, in an attempt to escape possible punishment. The PT and other parties are calling for his candidacy to be challenged, claiming that he has been ineligible for eight years. The case has not yet been judged.
