Fachin evaluates measures regarding suspicions involving STF ministers before the first round

This data could impact the definition of the next measures to be taken by Fachin and will be delivered on the eve of the first round of the presidential election.

A wing of the Supreme Court has been arguing that the discussion about whether or not to open an investigation against ministers Alexandre de Moraes and André Mendonça should wait until after the elections. This position is supported by ministers more aligned with Minister Alexandre de Moraes.

Behind the scenes, these members of the Court, heard with reserve, point out that the demonstrations on September 7th, with criticism of Moraes and defense of Mendonça, reinforce the electoral tone that the case gained.

These Supreme Court ministers say that the cases must also proceed together. Fachin's aides claim that the president has not yet decided what he will do, but that he considers the facts involving Moraes, vice-president of the Court, serious and that they demand a response.

Therefore, for those around Fachin, it would not be possible for the Court to continue ignoring the suspicions raised.

The president of the STF has been saying that he will adopt necessary measures at the right time. Moraes has not yet spoken publicly.

The following can speak out until September 14th: Mendonça, Moraes, the Attorney General of the Republic (PGR), Paulo Gonet, and the removed director of the PF, Andrei Rodrigues.

Fachin questioned, for example, whether the rules for investigations involving people with privileged jurisdiction in the Court were observed. And, also, whether there was any improper access to the PF's confidential report on Moraes, indicating that there may have been a leak of information.

Moraes pointed out that the material indicates that there was administrative improbity, abuse of authority, crime of responsibility and favoritism towards certain political groups in the reporting of the Master and INSS cases by Mendonça.

The PGR will have to comment, among other points, on the legality of the material. After the Prosecutor's Office, Mendonça will have until September 21st to provide the information, if he wishes.
