KAS inspections in Małopolska - fines for not having a cash register

In September, KAS officers appeared, among others, at the harvest festivals in Poręba Górna, Przeginia, Bukowska Wola and Kraków. Inspectors found that some sellers do not use cash registers. They also noticed a lack of proper supervision over sales recording. There were fines ranging from PLN 600 to PLN 3,000.

In Małopolska there was no information before this festival, before the harvest festival. The tax authority, in this case the head of the Customs and Tax Office, should contact the organizers and present a clear situation on when sales are allowed, how to sell and what is required by law - admitted the head of the National Tax Administration, Marcin Łoboda, in an interview with RMF FM.

Łoboda also emphasized that although the applicable regulations are generally available, the failure to inform the organizers in advance was a mistake. One basic thing: before the organization, it should be informed that there may be such inspections and what the consequences are, he added.

"We cannot leave such reports"

The head of KAS also pointed to the motivation behind the inspections.

This is always based on the analysis primarily of signal information, i.e. denunciations from ordinary citizens. And we cannot leave such reports and postpone them ad acta, but - unfortunately - we are obliged to check certain elements to see whether this is actually happening or not. If we did not do this, there would be an accusation that the tax administration is not performing its tasks - he explains.

As he emphasized, KAS does not operate by hunting for occasional sellers, but is guided by the obligation to verify reported irregularities. We are not focused on anyone, whether they are housewives, rural housewives' groups, or any other entities that occasionally sell anything once a year. And here, in my opinion, we are not against this activity. On the contrary, we will support it, declares the head of KAS.

The head of KAS also declared that the services subordinate to him are to be more proactive in informing event organizers about formal requirements.
