The file in the case of violence against a child with autism in Mersin was sent to the High Criminal Court

S.P.C., who was arrested on April 21 for allegedly committing violence against a 5-year-old child diagnosed with "atypical autism", the child's family and the lawyers of the parties attended the hearing held at the Mersin 25th Criminal Court of First Instance.

The court judge stated that there were findings in the expert report that the defendant used violence against the child on different dates.

It was reported that a new indictment was prepared following the criminal complaint filed by the Provincial Directorate of Family and Social Services on the grounds that the nature of the crime charged may change. In the indictment, it was requested that the defendant be punished for the crime of "torment" due to his actions on different dates. The case files were also combined.

Defendant S.P.C. In his defense, he said, "It is very sad to be accused of torture. Working with autistic children requires much closer contact. From time to time, I was asked to go a little beyond the limits of disabled children. Pushing the child and wiping the saliva from his mouth was perceived as hitting. I did not do anything to intentionally injure the child. My goal was to educate the child, to receive God's blessing, and to make his family happy. I regret teaching the child anything. I wish I had not made an effort. I tried to explain that I had not harmed anyone for 5 months." "I'm working," he said.

K.Y.'s mother, Sermin Yılmaz, claimed that the defendant's defense was aimed at avoiding the accusations.

Yilmaz said, "He finds a cover for everything, but what kind of education was he giving when he was pulling my child's ear? I don't understand this. I trust Turkish justice. I hope that those who will touch our children from now on will refrain from the decision of the court."

Father Bahattin Yılmaz also demanded that the defendant be punished.

Explaining his opinion on the merits, the prosecutor stated that the defendant had the title of "public servant" in the institution and work environment where he worked as a contracted personnel.

The prosecutor expressed his opinion that the actions should be evaluated within the scope of the crime of "torture" on the grounds that the victim child was subjected to persistent and systematic violence in a way that was incompatible with human dignity.

He requested that the court decide not to have jurisdiction and send the file to the High Criminal Court.

Asked for his last words, S.P.C. said, "I am astonished. God knows how I approach children. I request my release."

Following the statements of the parties, the court gave a decision of lack of jurisdiction. It was decided that the file be sent to the High Criminal Court to be evaluated within the scope of "torture" accusation.

The court also decided to continue S.P.C.'s detention.

S.P.C., who allegedly used violence against 5-year-old K.Y. at an Autism Family Counseling Center in Mersin. He was arrested.

The indictment prepared by the Mersin Chief Public Prosecutor's Office for the defendant, requesting imprisonment of up to 2 years and 3 months for the crime of "deliberate injury to a person who is physically or mentally unable to defend himself", was accepted by the Mersin 25th Criminal Court of First Instance.

The Provincial Directorate of Family and Social Services also filed a criminal complaint with the prosecutor's office on the grounds that the nature of the crime may change following the findings in the expert report.
