Afterwards, the President of the Court, Edson Fachin, asked if any minister would like to declare themselves impeded or suspected. Kassio Nunes Marques and Dias Toffoli then spoke out and decided not to participate in the trial.
Minister Kassio Nunes Marques was the first to ask to speak. He cited messages found on Daniel Vorcaro's cell phone, leaked to the press hours before the opening of the session. The messages deal with alleged favoritism towards his son. In one of them, from July 2025, Vorcaro sends Luiz Renó, former legal director of Banco Master, the name of lawyer Kevin Marques, son of minister Kassio, and his telephone number. Renó then asks: “This one, R$500,000 per month. Can you keep it?”
In this Tuesday's session (15), Kassio Nunes Marques stated that he never exchanged messages with the banker and that his son never received benefits:
"My son has never provided any service to the bank and has never been paid by the bank. This is a fact, because bank secrecy has already been broken. There is no point in speculating otherwise, because, if secrecy has already been broken, there are no arguments against facts. If I felt uncomfortable or co-opted in some way, I would never have voted to confirm the arrest of Daniel Vorcaro, his father and other people involved."

Even so, the minister claimed that this Tuesday's judgment (15) could have an influence on the election and that, as he is president of the Superior Electoral Court, he preferred to declare himself prevented from participating:
"I have no doubt that, despite it, and the debates will flow, that this trial could eventually also impact the political-electoral scenario. So, as president of the TSE, I do not feel comfortable participating in this trial and I declare my impediment."
Nunes Marques asked to leave the session.
Minister Dias Toffoli also asked to speak. He recalled that he withdrew from reporting on the Master case after he acknowledged being a partner in a company that sold a stake in a resort to a fund linked to banker Daniel Vorcaro. The decision to leave the rapporteurship took place in February 2026, after a closed meeting between all the Court's ministers, held after a lot of pressure. Since then, Toffoli has not participated in processes related to the Master in the Second Panel of the STF.
This Tuesday (15), the minister reaffirmed that there is no evidence of a crime committed by him, but decided to declare himself a suspect on an intimate basis and not participate in the trial:
"I understand that, as I have expressed myself in the class due to suspicion, reinforcement, not because I feel impeded, but due to suspicion, on an intimate basis, for the preservation of the Court, from the point of view of possible speculations, even knowing that the decision has become final, I declare my suspicion to participate in this trial".

During Dias Toffoli's demonstration, there was the first moment of tension in the plenary. Minister Flávio Dino interrupted his colleague and asked to make an aside, a brief speech while Toffoli had the floor. President Edson Fachin interrupted Dino's intervention and said that the request to speak should be addressed to him.
Edson Fachin: Minister Flávio, I would like to agree: in this session, the floor will always be requested from the Presidency.
Flávio Dino: I will follow the Court's internal regulations.
Edson Fachin: Which says that the floor is requested from the Presidency.
Flávio Dino: The aside is addressed to the rapporteur.
Edson Fachin: No. Your Excellency needs to ask the Presidency to speak. That's what I'm telling you.
Flávio Dino: President, I will follow the Court's internal regulations.
Edson Fachin: Well, Your Excellency will have the floor because I am giving it to you.
Flávio Dino: I will follow the Court's internal regulations.
