TRE approves Deltan Dallagnol's eligibility to run for the Senate in Paraná

The discussion of the case revolves around the TSE's 2023 decision, which revoked Dallagnol's candidacy registration, at the time in Podemos, which resulted in the loss of his mandate as a federal deputy.

At the time of the impeachment, the case's rapporteur, Minister Benedito Gonçalves, understood that Dallagnol committed fraud against the Clean Record Law by requesting dismissal from the Federal Public Ministry (MPF) 11 months before the elections, while facing internal processes at the institution that investigated the conduct of the then prosecutor for Operation Lava Jato. The processes could lead to dismissal — and, consequently, Dallagnol's ineligibility.

The Ineligibility Law does not allow candidacy from anyone who leaves the Judiciary or the Public Prosecutor's Office to escape punishment.

➡️ Remember: Dallagnol ran for the 2022 elections. The TRE approved the candidacy registration. There was an appeal to the TSE. As he did not have a definitive decision, he participated in the election and took office. When the case was judged by the Superior Court, the candidacy registration was revoked. Consequently, Dallagnol lost his position.

In this context, Dallagnol requested to register his candidacy to run as senator of Paraná. The eligibility declaration application was analyzed again and, by 4 votes to 3, the TRE decided that he is eligible to contest the elections this year.

Dallagnol's defense points out that, currently, there is no more Administrative Disciplinary Process (PAD) pending. Of the 15 complaints against the former prosecutor, 12 were archived, two were time-barred and one could result, at most, in censure. According to the defense, none of them would meet the requirements to make Dallagnol ineligible, that is, dismiss him from the PAD.
