TRE-RR fines Soldado Sampaio and Republicans for early election propaganda

The action against Sampaio and the Republicans was filed by the coalition "Unidos por Roraima", formed by PL and Novo, a group that has Arthur Henrique (PL) as a candidate for government and Sampaio's main opponent in the dispute.

In a note, the Republicans' defense informed that the process was analyzed without the party's defense, which, in the defense's assessment, constitutes the nullity of the decision. Currently, there is still an appeal, called declaration embargoes, pending analysis in the TRE. Soldado Sampaio's advisor was also contacted, but did not respond until the last update of the report.

In the process, the coalition stated that the materials with Sampaio's image and ballot box number were installed during the party convention, on August 5, and remained exposed for four days afterwards, until the 9th. The thesis was accepted by the TRE.

"The members of the Regional Electoral Court of Roraima unanimously agree to partially judge the representation, to recognize the characterization of early electoral propaganda resulting from the extrapolation of the limits of intra-party propaganda and to apply to FRANCISCO DOS SANTOS SAMPAIO and REPUBLICANOS, individually, the fine of R$ 5,000.00 (five thousand reais)", mentioned in an excerpt of the decision signed by the rapporteur, judge Renato Pereira Albuquerque.

The court understood that the quantity and way in which the materials were installed produced a visual effect similar to that of a billboard and allowed advertising to reach people outside the party environment.

TRE-RR also highlighted that the absence of an explicit request to vote does not eliminate irregularities when advertising uses a medium prohibited by electoral legislation.
