The female team leader brought a group to Taiwan last year and was almost sexually assaulted by a driver named Yang. She pretended to be in a hurry and hid in the toilet to seek help before she escaped. After hearing the case, the Tainan District Court sentenced him to 2 years in prison for the crime of attempted forced rape.
The verdict pointed out that the female tour leader led a group to Taiwan in mid-July last year, and Yang served as the group's driver. On the night when the tour group checked into a Tainan hotel, Yang invited the female tour guide to the room for a drink. He once touched the woman's knees while the tour guide was out, but was avoided. After the party, Mr. Yang actually followed the woman into the room under the pretext of visiting the room. He ignored the woman's refusal, forcibly hugged her from behind, touched her breasts, held her down on the bed, pulled her shorts, and verbally harassed her. The female tour leader struggled hard, and she pretended to be in a hurry and hid in the bathroom. She called the tour guide for help through a mobile phone call. The tour guide came and knocked on the door, but Yang opened the door angrily and left.
Faced with the accusation, Mr. Yang denied committing any crime, arguing that he was kind enough to accompany the tour guide back to the room after she reported feeling unwell. He only stood by the door throughout the entire process, without any physical contact or suppression. The defense lawyer argued that the woman did not call the police immediately, but the tour guide later coordinated the claim for HKD 48,000. He questioned whether the two colluded to set up a trap to defraud money, and there was a lack of injury examination sheets and trauma photos after the incident. The woman's one-sided words cannot be relied upon to convict.
The Tainan District Court held that the female team leader had no grudges against Mr. Yang. The circumstances of her accusations were always consistent. She had an emotional breakdown after returning to Hong Kong and intensively sent distress messages such as "I can't hold it in" and "I can't hold it tight", which were consistent with the trauma of the victim. Coupled with complete evidence from surveillance footage and communication records, the theory of collusion to seek money is purely conjecture. The judge considered that Yang Nan was pursuing his own selfish desires and infringing on other people's sexual autonomy. After the crime, he denied all the crimes and failed to pay compensation. Considering that he had failed and had no previous convictions, he sentenced him to 2 years in prison according to the law. The whole case can be appealed.
