An investigation team leader said that the police need to query various information when handling cases, including household administration, supervision, surveillance and other systems. According to the current "Implementation Measures for the Inquiry of Telecommunications Communication Records by Relevant Agencies in the Telecommunications Industry", the "price code" for the police's access to the communication is 10 yuan per page for one-way communication and 100 yuan for one day of two-way communication. Commonly used items by the police include real-time positioning for 5 yuan per time and Internet history records for 10 yuan per page. Article 8 of the Measures also stipulates that the investigation fees of judges and prosecutors may be reduced or waived.
The team leader explained that one-way communication refers to the dialing record of the door number, while two-way communication refers to the dialing and receiving calls; these two are usually used by the police to find out who the suspect has contacted and whether there are accomplices.
However, with the popularity of communication software nowadays, the number of traditional phone calls has plummeted, and network history records have become important, because they will show the Internet access status of the phone number during a specific period of time. Based on which base stations the mobile phone transmits signals, the suspect's movement trajectory and haunted area can be outlined. The police can then use the surveillance cameras to grasp the suspect. Real-time location refers to the base station through which the door number is currently transmitting signals. It is the basis used by the police to confirm the location of the suspect before arresting the person.
Another senior criminal police officer said that these communication fees may seem "small" at first glance, but for some drug trafficking groups and organized crime, the crimes spanned several months and there were many suspects, so the total amount transferred was considerable. Taking two-way communication as an example, each phone number costs 100 yuan per day and 3,000 yuan per month. Even if there is no record on that day, the fee will still be charged. In many past shootings and major criminal cases, in order to track down accomplices and the masterminds behind the scenes, the communication fee for a single case has been as high as hundreds of thousands of yuan.
Since the police have limited fees for accessing communications, in cases where the crime takes a long time and the number of suspects is large, the police will ask the prosecutor to direct the investigation. One of the considerations is to save money. Because prosecutors and judges currently do not need to pay telecommunications companies to access communication records, this "unequal treatment" has accidentally become an information security loophole under the manipulation of thoughtful people.
