As workers return to the workplace after turning 65, the Ministry of Labor reminds employers to take out disaster insurance for them

Taiwan has entered a super-aged society, and it is no longer unusual for workers to re-employ after retirement. According to statistics from the Ministry of Labor, as of the end of July 2015, there were more than 630,000 workers who had received labor insurance old-age benefits and then returned to work and participated in disaster insurance. Among them, workers over 65 years old accounted for more than 50%, reaching more than 344,000. The Ministry of Labor reminds employers that as long as workers are employed to work, employers should insure workers' occupational accident insurance (disaster insurance) in accordance with regulations to protect work safety and rights.

The Ministry of Labor often receives inquiries from workers. Can I continue to participate in labor insurance after returning to the workplace after being over 65 years old? The Ministry of Labor stated that this depends on whether the worker has participated in labor insurance and whether he has received labor insurance and old-age benefits. If an employee has participated in labor insurance and has not yet received old-age benefits, and is re-employed to work, he or she must continue to participate in labor insurance according to regulations. However, if an employee has previously received labor insurance and old-age benefits, or has no record of adding labor insurance before the age of 65, he or she is not allowed to participate in labor insurance when he or she is re-employed after the age of 65.

However, the Bureau of Labor Insurance emphasizes that even if you are unable to participate in labor insurance, you must remember to take out disaster insurance. According to the "Labor Occupational Accident Insurance and Protection Law", workers who are over 15 years old and employed in units that have a professional license, have been registered in accordance with the law, and have tax registration and other registration records are the compulsory insurance targets for disaster insurance. Even if the employee is over 65 years old and cannot participate in labor insurance, the employer must declare to participate in disaster insurance on the day the employee comes to work. If the employer fails to apply for additional insurance in accordance with the regulations and it is found to be true, he will be fined not less than 20,000 yuan but not more than 100,000 yuan, and the reasons for the violation will be announced.
