A woman surnamed Xiao from Kaohsiung traveled to Xinjiang, China for 12 days in a group last year. Unexpectedly, this dreamy trip to northern Xinjiang became a "hell tour" in the eyes of the group members. The group member surnamed Chen was dissatisfied with the lack of a leader or tour guide, and even suffered from hunger and hypoglycemia many times. She trembled and reported directly to the local police. After reporting the case, the group members even accused Zhu Lai of fraud after returning to Taiwan. Although Zhu Lai was eventually dismissed from prosecution, he counter-accused the group members for infringement of reputation and demanded 100,000 yuan in compensation. After hearing the case, the Qiaotou District Court found that the group members acted to protect their own rights and interests rather than malicious fabrication, and ruled that Zhu Lai lost the lawsuit.

The verdict stated that Xiao Nu organized a tour group to Northern Xinjiang in June last year. A member of the tour group surnamed Chen complained that when they arrived there, they discovered that there was no professional tour leader at all, but a "driver-cum-tour guide", and that the driver could not accompany him into the scenic spot, leaving the group members to fend for themselves in the vast scenic spot. Chen Nan said that after breakfast at the hotel on the first day, he was not helped to arrange meals all day long, which caused him to "several times starved to the point of hypoglycemia and trembling all over." During the trip, some members of the group even had foot injuries, colds and fevers, but the host did not provide medical assistance. After the host returned to Taiwan, she was unwilling to alarm the public security overseas. After returning to Taiwan, she was tired of rushing to the police station and the Qiaotou District Prosecutor's Office. Therefore, she asked the members for transportation expenses and emotional comfort of 100,000 yuan.

The judge held that the group members reported to the police and lodged the complaint based on actual painful experiences and subjective belief that their rights had been damaged. They were not completely fabricated or maliciously fabricated. Even if Zhu Lao was eventually given the sanction of non-prosecution, it could not be concluded that the group members had subjectively committed intentional or negligent infringement of Zhu Lao's reputation. Accordingly, Zhu Lao's compensation request was rejected and the members of the group were exempted from compensation. The entire case remains open to appeal.
