The National Association of Federal Police Delegates (ADPF) asked, in a note released this Saturday (5), that the Attorney General of the Republic, Paulo Gonet, declare himself prevented from investigating possible interference in a Federal Police report requested by Minister André Mendonça, of the Federal Supreme Court (STF), which cites Daniel Vorcaro's relationship with Minister Alexandre Moraes and the PGR himself.
"The ADPF requires that the Attorney General of the Republic declare himself impeded and refrain from carrying out acts, whether as a law enforcement officer or as a holder of external control, in procedures related to the facts in which he is cited; that the procedure initiated be archived as it is an inappropriate way to question the STF's act; and that the facts that came to light through Operation Compliance Zero be investigated in their entirety, without selectivity regarding the authorities involved", says the note.
"Additionally, the report mentions by name the Attorney General of the Republic. Article 258 of the Code of Criminal Procedure extends the rules of impediment and suspicion of judges to the bodies of the Public Prosecutor's Office, for the same reason that it prohibits anyone from deciding in their own cause", states the note.
The association states that the objective effect of the measure is intimidating on investigators "regardless of any judgment about intentions, which the ADPF does not formulate."
"The questioned document was produced by order of the Minister who was the rapporteur of the case at the Federal Supreme Court. The Delegates and civil servants who participated in it complied with the court order, within the strict limits established therein, with no room for their own judgment of convenience regarding what was determined by the competent court", says the text.

Investigation on report
The Attorney General's Office (PGR) informed the president of the STF, minister Edson Fachin, who opened an investigation into possible interference in the production of the report.
"I inform Your Excellency that, in the form of the order I forward, I determined the establishment of a Procedure for External Control of Police Activity, the result of which will, in appropriate time, be notified to the Court", wrote the Attorney General of the Republic, Paulo Gonet.
The PGR states that the PF will have to clarify, for example, “regarding the possible occurrence of order or external interference in its preparation, which has tainted its content”.
🔎 The measure is part of the so-called external control of the police, which is a responsibility of the Federal Public Ministry and was taken in the wake of the request for clarification made by the president of the STF, Edson Fachin, regarding the production of the material.
The prosecutor's office claimed that it was not informed about Mendonça's determination.
"In the process analyzed, no space was given to the manifestation of the General Prosecutor's Office of the Republic. On the contrary, the decision made in the files of Petition No. 15,556/DF was hidden from the Public Prosecutor's Office, which was thus prevented from carrying out the necessary external control of police activity, an essential step in any investigation", he stated.
Gonet responded to Fachin's order to provide information about the case, which was reported by Mendonça, and is now under the command of the president of the STF.
Master Crisis at the STF
Last Tuesday (1st), minister André Mendonça removed the confidentiality of a Federal Police report that exposes messages and contacts between banker Daniel Vorcaro and minister Alexandre de Moraes.
🔎 Moraes, Andrei and Gonet were mentioned by Daniel Vorcaro in messages obtained by the Federal Police on the cell phone of the owner of Banco Master.
Exchanges of messages between Moraes, from the STF, and Vorcaro indicate that the minister was discussing with the former owner of Banco Master the possibility of the PF launching an operation that would target the former banker.
Mendonça suggested in the same decision that the elements contained in the PF reports on the case be evaluated by the Court's plenary.
After the information was released, the rapporteur also ordered the PGR to give its opinion on the topic. Attorney Paulo Gonet – mentioned in the reports published by Mendonça – stated that the investigation is null and could not have been carried out without a request from the Public Ministry or the PF itself.
