Flávio Bolsonaro visits Filipe Martins in prison and criticizes Alexandre de Moraes

Presidential candidate Flávio Bolsonaro (PL) interrupted his campaign commitments this Saturday (5) to visit Jair Bolsonaro's former advisor, Filipe Martins, who is imprisoned in Paraná. Martins was sentenced to 21 years in prison for attempted coup d'état.

Martins was under house arrest until January 2 of this year, but was arrested at the Hildebrando de Souza Public Prison, in Ponta Grossa, after failing to comply with the precautionary measure that prohibited him from using social media. The decision was made by the minister of the Federal Supreme Court (STF), Alexandre de Moraes.

The candidate for the government of Paraná, Sergio Moro (PL), and the candidate for the Senate, Filipe Barros (PL), were also in the prison. On his way out, Flávio Bolsonaro answered questions from the press and criticized Minister Alexandre de Moraes, who suspended the application of the Dosimetry Law until the Federal Supreme Court (STF) analyzes actions that question the rule.

"So Filipe Martins is here. If the dosimetry law were in force, he should already be at home. So Brazil is going through very bad, very difficult times and once again, we need to protect the institution that is the Federal Supreme Court. This will be my role as president of the republic, to rescue the credibility of the institutions and not protect people, because today Alexandre Moraes is a rotten orange within the Federal Supreme Court", he said.

Minister Alexandre de Moraes ordered the arrest of Filipe Martins after a complaint alleging non-compliance with the precautionary measure banning the use of social media (imposed by house arrest). According to the minister, "news was added to the file that the convicted defendant had used the social network Linkedin to search for third-party profiles."

In the decision ordering the arrest, Moraes states that the man's own lawyers recognized the violation.

"Effectively, there is no doubt that there was non-compliance with the imposed precautionary measure, since the defense itself recognizes the use of the social network, with no relevance to the defensive allegation in the sense that social networks were used to 'preserve, organize and audit past informational elements relevant to the exercise of broad defense'. The accused demonstrates total disrespect for the imposed norms and constitutionally democratic institutions, as, by using social networks, he offends the precautionary measures applied, as well as the entire legal system", says Moraes.

Filipe Martins was convicted by the 1st group of the STF

FIlipe Martins, who was special advisor for international affairs to the Presidency in the Bolsonaro government, was sentenced to 21 years in prison on December 16th by the first group of the STF for the following crimes:

Attempt, through the use of violence or serious threat, to abolish the Democratic Rule of Law, preventing or restricting the exercise of constitutional powers;

Attempt to depose, through violence or serious threat, the legitimately constituted government;

Destroy, render useless or deteriorate someone else's property with violence to the person or serious threat, against the property of the Union, State, Federal District, Municipality or agency, public foundation, public company, mixed capital company or company providing public services and for selfish reasons or with considerable harm to the victim;

Promote, establish, finance or integrate, personally or through an intermediary, a criminal organization with a public servant competition;

Destroy, disable or deteriorate property especially protected by law, administrative act or court decision.

In addition to him, five other defendants from the so-called "core 2" of the coup plot were also convicted. All are accused of being part of one of the cores of a criminal organization to keep former president Jair Bolsonaro in power, even after his defeat at the polls.
