Decision to file a criminal complaint in the Alya Uçar Apartment case

As a result of the collapse of the Alya Uçar Apartment in the Ekinci District of Hatay's Antakya district during the February 6 earthquakes, 14 people, including 2 babies and 1 child, lost their lives.

A lawsuit was filed against contractor Hikmet Günsay, construction site manager Adem Sabırlı, static project designer Ayhan Girişken, application inspector Ali Şahin, project and application inspector Antuvan Ayrancıoğlu and ground survey project designer Salih Zorsu for "causing death and injury by negligence". There is no detained defendant in the file.

In the case heard at the Hatay 3rd High Criminal Court, in the expert report entered in the file recently, it was stated that the contractor, site manager, static project designer, building inspection company official and project and application inspectors were responsible for the demolition of the building. In the report, non-case building inspection agency official Mustafa Akıncı and application inspector Raşit Akyurt were also among those responsible.

Those who lost their relatives in the earthquake and the lawyers of the parties attended the 6th hearing held on September 24.

CRIMINAL COMPLAINT REQUEST FOR TWO NAMES OUT OF THE CASE

Alev Demirok, who lost her 11-year-old son in the earthquake, stated that the expert report held the defendants responsible and requested that the file be taken to decision.

The complainant's lawyer, Veysel Görücü, stated that the expert report found that the defendants were at fault and requested that a criminal complaint be filed against Raşit Akyurt and Mustafa Akıncı, who were out of the case.

The public prosecutor requested that the measures against the defendants under judicial control be continued and that the missing issues be resolved.

REQUEST FOR MULTIDISCIPLINARY EXPERT REPORT

The defendant's lawyers demanded that the expert report not be taken as a basis for the decision, that the experts be heard at the hearing, and that a report be received from a new multidisciplinary committee in line with the Supreme Court decisions.

The court panel decided to file a criminal complaint with the Chief Public Prosecutor's Office against Mustafa Akıncı and Raşit Akyurt, whose responsibilities were determined in the expert report, to evaluate the requests for new expert reports after the missing issues are eliminated, and to reject the request to hear the experts at the hearing. The hearing was postponed to December 17.
