Businessman Alexsandro Ichisato de Azevedo, convicted of running over and killing student Marcos Delefrate during the 2013 demonstrations in Ribeirão Preto (SP), told technical evaluators that he intends to open a vehicle buying and selling store or work in construction when he leaves prison.
"The intention is to return to family life in Ribeirão Preto, to start again with a vehicle buying and selling store or in construction", stated the social worker in the document.
The statement appears in the report of a social worker who was part of the team responsible for evaluating the convict, carried out after almost a year of waiting for the defendant.
The exams were carried out at the Compact Penitentiary of Tupi Paulista (SP), where Ichisato is serving a prison sentence for double homicide and for four attempted homicides - for injuring other protesters.
The reports are mandatory to support the progression to the semi-open regime requested by the defendant, who has already served 13 years in prison, more than two thirds of the total sentence of 18 years, and is entitled to the benefit, if he shows good behavior.
Amid legal discussions about the need for the exams and due to the demand for pending evaluations in the prison system, the exams were requested in September 2025 by Ichisato's defense and were only authorized in April of this year, effective only on August 24th.

The request still depends on analysis and decision by the Court, but, in an opinion issued on September 18, the Public Ministry took a position against the benefit.
Although the reports indicate Ichisato's good conduct in prison, prosecutor Lincoln Gakiya was based on the seriousness of the crime committed in 2013, disciplinary offenses in 2022 and a possible risk of escape given the remaining sentence until 2031.
Ichisato's defense, in turn, considered the Prosecutor's opinion unreasonable and argued that the request meets all legal requirements.
"Progression depends on simple requirements: the person having served the necessary sentence and having a good evaluation of the penitentiary. He fulfilled these requirements, so the Public Prosecutor's Office could not have objected to this", said lawyer Wagner Simões.

The social report indicated that Ichisato presented a collaborative stance and reflection on his procedural situation.
"The sentenced person demonstrated critical reflection on his actions, is aware of his current condition, understands it as a consequence of mistakes made in the past", commented the social worker in the opinion.
In the psychological report, a psychologist recorded that the convict demonstrated accelerated communication, a euphoric mood and a high level of anxiety during treatment.
The professional analyzed that the inmate has preserved psychic functions and memory, but has impulsive personality traits.

In relation to the crime committed in 2013, the psychological assessment noted that the businessman only assumes partial responsibility.
"Regarding the crime for which he is serving his sentence, the convict partially admits it, stating that he did not have much idea of what was happening at that time, claiming to be under the influence of benzodiazepines and hypnotics", said the psychologist in the report.
To social services, the inmate justified the conduct as an atypical event resulting from lack of emotional control.
In terms of the prison's dynamics, the reports indicate that the inmate records good recent prison behavior, with no records of infractions in the last 12 months.
Although he was not carrying out work or study activities at the time of the exam, the unit's Technical Classification Committee issued an opinion in favor of relaxing the regime.
Understand the case
The collision occurred on June 20, 2013, during popular protests at the intersection of Professor João Fiúsa and Adolfo Bianco Molina avenues, in Ribeirão Preto.
After a disagreement with protesters who were blocking the public road, Ichisato accelerated the SUV into the crowd, causing the death of student Marcos Delefrate, 18, and injuring other pedestrians.
The driver fled the scene without providing assistance and was located and arrested by the police on July 18, 2013, in Bragança Paulista (SP).

In February 2020, the 2nd Jury Court of Ribeirão Preto set the defendant's sentence at 64 years of closed prison.
In September 2021, the 4th Criminal Law Chamber of the São Paulo Court of Justice accepted a defensive appeal and reduced the sentence to 18 years and 8 months in prison.
In February 2022, the defendant was progressed to the semi-open regime. But the benefit was revoked after the businessman committed two serious disciplinary offenses in April and September 2022, in the Itirapina (SP) and Guareí (SP) penitentiaries.
On April 25, 2023, Ichisato was transferred to the Tupi Paulista Penitentiary, where he remains detained pending analysis of the new request.
