Fachin defends that TSE decides on the case of publications involving Flávio Bolsonaro before the STF

The blog found that Fachin asked the TSE to decide first on the Aparecida case so that the Supreme Court can only then evaluate the issue — including whether it will still be an issue.

In this conversation, Fachin asked to, first, see the position of the TSE board on the decision and, only then, assess whether it will be necessary for the Supreme Court to act, based on the decision that comes out of the virtual plenary.

This Wednesday (30), the TSE analyzes the decision of Minister André Mendonça who removed the publications that associated the candidate Flávio Bolsonaro (PL) with an alleged movement to remove Our Lady of Aparecida from the position of patron saint of Brazil.

On Monday (28), Minister Luiz Fux, of the Federal Supreme Court (STF) suspended the decision of Minister Flávio Dino who had overturned Minister Mendonça's order.

In practice, this means that posts must remain offline.

The trial began at the TSE, with Mendonça's decision. An appeal took the case to Minister Flávio Dino, of the STF, who suspended the decision and took the matter to the Supreme Court.

The defense of candidate Flávio Bolsonaro filed a new action sent to Luiz Fux, who suspended Dino's decision and resumed the effects of the ban decreed by Mendonça.
