Clash between Tajani and the ANM over the management of red-handed arrests

"Citizens have a sacrosanct right to safety. As happened in Turin, too many people arrested in flagrante delicto are immediately released by forgiving magistrates. This creates social alarm and demotivates the police and carabinieri". Deputy Prime Minister Antonio Tajani writes it in X.

"It is sufficient to speak with the police and with those who live in neighborhoods with a high crime density to understand what I mean. I have never asked for the law to be disapplied, but on the contrary to be applied in full. And I have asked the magistrates to put a hand on their conscience every time they choose to release those who have been caught in the act and, once free, are ready to repeat the crime. The perception of impunity only helps the criminals. Invoking the rule of law with those arrested in the act is therefore instrumental. The rule of law requires that no innocent person should end up in prison. Not that those arrested in the act can go back to crime the next day."

"The words of the Vice President of the Council are astounding because they give space to a logic that is contrary to any rule of law. Magistrates must simply apply the law. Security cannot be guaranteed by placing the responsibility on the judiciary. Justice is not and cannot be an instrument of intimidation towards anyone". Thus the central executive council of the National Magistrates Association in a note referring to the words of the deputy prime minister Antonio Tajani, for whom "much more rigidity is needed on the part of the judiciary" on the validation of arrests, so that "signals are given that guarantee citizens that thugs cannot act with impunity".
