TRE maintains Elmano's conviction for propaganda that linked Ciro to Bolsonaro

g1 sought out Elmano de Freitas's office to comment on the case, but did not receive a response. This Tuesday (22), Elmano commented on the conviction at a press conference and said that "the Judiciary has the right to have an understanding that it considers to be the most appropriate regarding its interpretation of the law." The governor also stated that he will appeal.

In the advertisements analyzed, the "Ceará Forte, do Lado Certo" coalition, which unites the parties that support Elmano, used videos of Bolsonaro and Ciro and, in the end, used the phrase "Ciro and Bolsonaro are now on the same side" and the term "Cironaro".

The judge reporting the case, Magno Gomes de Oliveira, pointed out that the videos used are true, but stated that the interspersed editing of one video with another, the narration and the propaganda texts led to a conclusion that could not be proven by the videos themselves.

The TRE board considered that the advertisements led the electorate to the conclusion that Ciro Ferreira Gomes was aggressive against women, "a circumstance that, in the context of the propaganda, would exceed the limits of political criticism and affect the honor and image of the candidate. As a result, the right of response was granted".

The original convictions occurred, respectively, on the 18th and 19th of September, for the loss of 29 minutes and 47 minutes of advertising, totaling 76 minutes of TV and radio time. However, the decisions were suspended due to appeals made to the TRE, until the collegiate's deliberation, which occurred on September 21st.

The waste of time concerns insertions on TV and radio, that is, the advertisements that appear throughout the day, and not the free electoral time block. With the collegiate's decision to maintain the convictions, the insertions that would have been Elmano's now belong to Ciro's campaign until the 76 minutes are up.

The TRE, however, pointed out that the response from Ciro's coalition must be limited in its content, "without rhetoric, adjectives, self-promotion, disclosure of achievements or presentation of campaign proposals".
