TST determines maintenance of 60% of Caixa employees during strike

Preliminary decision by the minister of the Superior Labor Court (TST), Mauricio Godinho Delgado, determined that the minimum percentage of 60% of Caixa Econômica Federal employees be maintained in service, during a strike declared on September 10th.

The measure comes after Caixa Econômica Federal filed a collective strike agreement against the National Confederation of Workers in the Financial Sector (Contraf) and the National Confederation of Workers in Credit Companies (Contec), on Thursday (24).

Caixa's request to the TST requested the maintenance of 80% of staff in activity, claiming a direct impact on essential services, such as bank compensation and the payment of social benefits. The company also justified the lack of consensus in negotiations regarding the new funding model for the Saúde Caixa plan.

According to the TST, the percentage of 60% considered the preservation of meeting the urgent needs of the community, without making the constitutional exercise of the category's right to strike unfeasible.

Negotiations

In a note, the coordinator of the Executive Committee of Employees (CEE), Luiza Hansen, informed that the workers had already asked the bank to continue negotiations, through a letter sent on Tuesday (22). She also highlighted that the request remains maintained.

"We believe that negotiation is always the best way to reach a solution. Filing a lawsuit is never the best way and can cause great losses, especially in the trial phase. We hope that there is still the possibility of moving forward with conciliation."

In the preliminary decision, the minister also guaranteed the maintenance of the Collective Labor Agreement, effective between September 2024 and August 2026, until the final decision of the case.

Minister Delgado also denied the prohibition of activities that hinder free access to agencies, highlighting that there is no evidence of excess on the part of the strike movement.

The judgment of the collective dispute by the Specialized Section in Collective Disputes (SDC) of the Superior Labor Court is scheduled for 2:30 pm next Tuesday (29).
