The reasons for nonconformity specified in the Enforcement Rules of the Construction Machinery Management Act are diverse, ranging from not attaching a registration number tag to missing fuel device seals, liquefied petroleum gas leaks, non-compliance with safety standards for structures and devices, and severe corrosion, deformation, and damage to the chassis and body.

The number of construction machines that were judged nonconforming but did not undergo re-inspection was 2,401 in 2021, 2,350 in 2022, 187 in 2023, 397 in 2024, 526 in 2025, and 221 as of August this year.

However, it is not confirmed whether construction machinery that has not been re-inspected continues to be used on site. The management center responded to Assemblyman Kim's office, saying, "We do not have any data on whether construction machinery that has not undergone re-inspection is in operation."

During the same period, there were a total of 18,914 cases in which illegal modifications were confirmed and notified to construction equipment owners during the inspection process, with an annual average of 3,152 cases from 2021 to this year.

Representative Kim Mi-ae said, "The problem is that it is not possible to determine at a glance whether construction machinery that has exceeded the inspection period or has not been re-inspected after being judged unsuitable is actually used and operated, and whether follow-up administrative measures have been properly taken. We need to improve the management system to prevent such construction machinery from being used in the field."
