The lawyers of Simona Cinà's family are opposing the dismissal of the investigation into her death

The lawyers Antonio, Marco and Paolo Ingroia - lawyers for the family of Simona Cinà, the 21-year-old volleyball player who drowned in a swimming pool during a party in Bagheria last year - have filed an opposition to the dismissal of the investigation into the case, requested by the Termini Imerese prosecutor's office who coordinated the investigations. According to the lawyers of the Cinà family, "the act of opposition" - they explained during a press conference - "is divided into a series of observations regarding the inadequacy of the investigations carried out, the obvious investigative gaps especially in the first hours following the death of Simona Cinà, the incompleteness of the medical-legal investigations and the failure to delve into all the profiles from which negligent criminal liability could be highlighted". Furthermore, "the prosecutor's request" - in the opinion of the lawyers - "is based on a reconstruction that is not sufficiently demonstrated, contradictory and conditioned from the beginning by a prejudicial investigative hypothesis, tending to exclude any responsibility of third parties in the cause of the event, thus ending up favoring the reconstructive hypothesis according to which Simona's death would have been the consequence of an autonomous or accidental entry into the water, followed by the impossibility of re-emerging due to the serious state of alcoholic intoxication, without the influence of the conduct of anyone".

"Alternative hypotheses neglected during the investigation"

The investigations therefore - the lawyers argue - "appear conditioned by this prejudice, leading the investigators to neglect alternative hypotheses that contemplate the intervention, even if only negligent or accidental, of third parties". In short, we need to continue investigating because the possibility that Simona may have fallen into the pool due to a push - intentional or accidental - even as a joke has not been adequately explored. A thesis that is anything but abstract given that - the lawyers explain - the investigations revealed that during the same party there had been episodes in which other guests had been thrown into the water. In particular, another girl had also been thrown into the swimming pool with her clothes on and had also, a few hours before Simona's death, had difficulty re-emerging independently, so much so that she required the intervention of another guest. But it is also necessary to delve deeper into the positions of some whose conduct - active and omissive - could abstractly constitute liability for manslaughter. Just as this is always what the lawyers ask for with the opposition request - it is necessary to verify the position of the organizers of the party with around 80 guests, uncontrolled availability of large quantities of spirits, use of a poorly lit swimming pool at night, lack of supervision and loud music.
