At the time, the magistrate stated that a technical analysis carried out on data from Vorcaro's messages found that the single-view messages sent by him on November 17, 2025, the date of the former banker's first arrest, do not correspond to the contacts of minister Alexandre de Moraes in the seized files.

"The check showed that the screenshots and the respective contact are linked to other file folders and telephone directories on the sender's own computer, demonstrating that the messages were directed to other contacts and not to the minister", he said in the text.

These same messages appear in the report presented to Mendonça by the PF, with the indication that Vorcaro's interlocutor was Moraes.

The president's order then questions, among other points, compliance with the Organic Law of the Judiciary by the PF, possible access to private documents and confidential information and the circumstances of an investigation.

"It is up to the president of the court to ensure that the possible collegial assessment is carried out, in a timely manner, with the high sense of responsibility that the facts require, always ensuring respect for the constitutional guarantees of due legal process, full defense and adversarial proceedings", says Fachin.

According to the minister, even though the PGR raised doubts, in the request to annul the report, the information in the material requires action from the president of the court if recognized.

Fachin questions, in the document, the PF's compliance with procedures when authorities with special jurisdiction are identified in investigations.

The president also wants information about improper access to private documents through institutional credentials or about the leakage of confidential data to those under investigation.

Moraes' measure was taken as part of the fake news investigation. Moraes claims that Mendonça acted to direct the investigations, "with a breach of judicial impartiality and favoring certain political groups".
