National Association of PF Delegates calls for Gonet's impeachment in investigation into STF minister

The National Association of Federal Police Delegates released a note asking the attorney general, Paulo Gonet, to declare himself unable to act in the investigation investigating the conduct of STF minister André Mendonça. Mendonça is the Supreme Court rapporteur for cases involving Banco Master.

The minister had asked the PF to investigate information about messages sent by banker Daniel Vorcaro, owner of Master, and received a report from the PF in which the names of minister Alexandre de Moraes and the attorney general, Paulo Gonet, appear.

In this Saturday's note (5), "ADPF requires the Attorney General of the Republic to declare himself impeded and refrain from carrying out acts, whether as a law enforcement officer or as holder of external control, in procedures related to the facts in which he is cited"; that "the procedure initiated is archived as it is an inappropriate way to question the STF's act"; and that "the facts that came to light through Operation Compliance Zero are investigated in their entirety, without selectivity regarding the authorities involved."

The demonstration is a reaction to the opening, by the Attorney General's Office, of an investigation to investigate the circumstances surrounding the production of a Federal Police report in which the names of Moraes and Gonet appear.

In the order this Friday (4), the attorney general, Paulo Gonet, ordered the PF to provide clarifications on the preparation of the document, including, according to Gonet, on possible external interference that may have compromised its content. This is an investigation report used in the inquiry and carried out at the request of Minister André Mendonça.

Minister Alexandre de Moraes used another type of report, internal and intelligence from the PF, to request an investigation against André Mendonça. According to Moraes, the documents indicate that the colleague had directed investigations for personal and political reasons and committed crimes such as abuse of authority and breach of impartiality as a judge.

But, in one of the documents presented by Moraes, the Federal Police states that "the intelligence report that supported the demonstration has restricted dissemination, has no decisive character and no probative value"; and that "it does not investigate conduct, does not impute a criminal, disciplinary or functional infraction to a magistrate, a member of the Public Prosecutor's Office or the police authority, does not convey judgment on the validity of judicial decisions and does not replace the proper procedural route of challenge".

The document is from the Police Intelligence Data Analysis Unit, an intelligence body linked to the Coordination of Inquiries in the Superior Courts of the PF. However, it has no signature or authorship by those responsible for the content.

Questioned by Jornal Nacional, the PF did not respond about the specific case. But he reported that, "even though they are not signed, the individualization of the intelligence document, as well as the identification of the intelligence body responsible for its creation, is carried out in an automated way."

According to the note, "intelligence documents thus have principles, objectives, assumptions, means, sources and controls that are completely different from the activity of the judicial police, and their inclusion in the police investigation records within the scope of the Federal Police is expressly prohibited." Moraes joined PF intelligence reports in the request for Mendonça to be investigated.

Two delegates from the Federal Police advise Minister André Mendonça in the cases of Banco Master and INSS fraud. The actions of these delegates were one of the reasons for the tension between Mendonça and the director of the PF, Andrei Rodrigues, who defends the departure of the delegates from the offices. Minister Alexandre de Moraes is also advised by two PF delegates.
