TRE-AC denies registration of candidacy of Gladson Camelí and Antônia Lúcia for the Senate

The former governor of Acre Gladson Camelí (PP) had his request to register his candidacy for the senate denied by the Regional Electoral Court of Acre (TRE-AC) this Friday (11). An appeal can be made to the Superior Electoral Court (TSE), and the defense said it will appeal.

In a unanimous vote, the members of the electoral court were in favor of the arguments of the Public Electoral Ministry (MPE) which challenged his request for ineligibility due to the criminal conviction imposed by the Special Court of the Superior Court of Justice (STJ).

💡 By appealing, Gladson will be able to continue in the sub judice dispute. A sub judice candidacy is one that is still under analysis by the Court. In practice, the candidate can contest the election and receive votes, but the result depends on a definitive court decision.

Gladson's lawyers maintained throughout the process that the sentence was passed in just one instance, and that it is the result of a process that had part of the evidence annulled by the Federal Supreme Court (STF).

However, the case's rapporteur, jurist Thalles Sales, rejected the arguments and was in favor of the MPE's understanding. He was accompanied by five other members of the court.

Another application denied

This week, federal deputy Antônia Lúcia (MDB) was also rejected from her candidacy registration, who is seeking re-election. The parliamentarian's defense informed that it will appeal and that she will continue in the dispute sub judice.

Her request to run again for the position had been challenged by the Public Electoral Ministry due to a conviction for administrative improbity in 2025 by the Court of Justice of Acre (TJ-AC), a decision against which she continues to appeal.

When the candidate is in this situation, the votes are counted normally, but confirmation of victory and the candidate's diploma are subject to the judgment of the appeals that are still in progress.

In his opinion, the judge's rapporteur Lois Carlos Arruda highlighted that the sentence attributed to the federal deputy qualifies in the hypotheses provided for by the legislation known as the Ineligibility Law.

"In view of this situation, the criminal conviction handed down by a collegiate judicial body, for committing a crime against the Public Administration, remains valid and produces effects for electoral purposes, leaving the cause of ineligibility established [...]", he cited.

Antônia Lúcia said in a statement that she received the decision with respect, but that she will appeal to all appropriate instances. She was elected in 2022 with 16,280 votes and is seeking re-election.
