TSE analyzes Dr. Furlan's candidacy for the government of Amapá and voting is suspended after request for review

The Superior Electoral Court analyzed, in Brasília, this Friday (24), Dr. Furlan's candidacy request for the government of Amapá. The rapporteur of the process, Minister Dias Toffoli, voted to reject the candidate's registration. The vote was suspended after Minister André Mendonça requested a review, interrupting the analysis of the case.

In his vote, Toffoli determined that the Amapá Regional Electoral Court (TRE-AP) be informed immediately to remove the candidate's name from the electronic ballot boxes and suspend the sending of campaign resources.

With the request for review, the other ministers await the return of the process to cast their votes.

The appeal was taken to the TSE by the Public Electoral Ministry (MPE), after the TRE-AP released the candidacy. The organization maintains that Dr. Furlan resigned as mayor of Macapá with the aim of avoiding a possible investigation by the City Council.

Before the session at the TSE, the Electoral Attorney General's Office (PGE) had recommended the rejection of the candidacy. The PGE's decision was based on the chronology of the facts presented in the action, being:

March 4, at 12:15 pm: A request for an investigation against the former mayor was physically filed at the Macapá City Council.

March 4, at 5:15 pm: Five hours after filing the complaint, Dr. Furlan signed his resignation letter.

March 5: The resignation was officially presented to the House of Laws.

For the prosecution, the fact that the representation was filed before the resignation meets the requirements of electoral legislation to make the candidate ineligible.

The legislation requires disqualification by April 4 for anyone running for government, but the accusation argues that the early resignation sought to end the impeachment process in the Chamber.
