The Investigative Committee refused to initiate a criminal case into the death of Maxim Martsinkevich (Tesak) in the Chelyabinsk pre-trial detention center.

“After Martsinkevich’s death, several pre-investigation checks were carried out, but all of them ended in a refusal to initiate a case,” the agency’s interlocutor said.

The lawyer clarified that only based on complaints from the defense, the inspection was resumed four times. “I can tell you absolutely reliably about the 4 inspections carried out based on complaints from lawyers,” Mikhalchik said, not ruling out that the inspections could have been carried out for other reasons.

The lawyer emphasized that he would not appeal the decision of the Investigative Committee, but not because he agreed with the investigation’s version of suicide. “Until now, my father was sure, and I am sure, as a person who understood this from the legal side, that they helped him die,” Mikhalchik said.

According to him, the defense insisted on the need to consider not only the version of murder, but also incitement to suicide. Chelyabinsk was a transit point for Martsinkevich - he was traveling from Krasnoyarsk, where he wrote a number of confessions, some of which the Investigative Committee later recognized as unreliable. “We said that let’s start an investigation in Krasnoyarsk, establish his cellmates, how he was kept, what kind of damage he had,” Mikhalchik noted.

He also stated that “there were a lot of questions about the identified injuries” on Tesak’s body - their nature, according to independent experts, “suggests that violence was used against him.”

Mikhalchik noted that the main person who sought the truth was Martsinkevich’s father, but his health began to deteriorate and after his death “all actions stopped.” “This is not due to the fact that they agreed with the version of the Investigative Committee, but to the absence of a person who would like to continue these actions from among the relatives,” the lawyer explained.

Mikhalchik also said that there was video surveillance in the cell where Tesak was kept, but the recordings could not be obtained. According to him, the investigation referred to the fact that two weeks before Martsinkevich’s arrival at the pre-trial detention center, a lightning strike damaged the cells.
